Federal Insecticide, Fungicide, and Rodenticide Act<br />

The Federal Insecticide, Fungicide, and Rodenticide Act <strong>of</strong> 1947 (FIFRA), 7<br />

U.S.C. Section 136 et seq., has been amended four tLues, most recently by the Pesticide<br />

Monitoring Improvements Act in 1988. FIFRA requires the registration, cenification,<br />

use, storage, disposal, transponation, and recall <strong>of</strong> pesticides. The regulations are<br />

codified under 40 CFR Pans 150 to 189 (see New Mexico Pesticide Control Act).<br />

Operations that involve subsurface mining or the extraction <strong>of</strong> oil, gas, or potash<br />

would not be subject to 40 CFR Pans 150 to 165 and Pans 168 to 169, since these<br />

activities do not involve the manufacture <strong>of</strong> pesticides. If these operations use pesticides,<br />

they could be subject to the following regulations:<br />

• Worker protection standards (40 CFR Pan 170)<br />

• Cenification <strong>of</strong> applicators and experimental use (40 CPR Pan 171 to 172)<br />

• Standards enforcement (40 CFR Pan 173, 177 to 179)<br />

Documentation is required for reponing and recordkeeping purposes in the event<br />

<strong>of</strong> uncenified use <strong>of</strong> a pesticide under emergency conditions as defined in 40 CPR Pan<br />

166. Documentation is also required for certification <strong>of</strong> pesticide applicators (40 CPR<br />

Pan 171) and permitting for experimental use <strong>of</strong> a pesticide (40 CPR Pan 172). No fees<br />

are associated with FIFRA.<br />

Federal .MiDe Safety and Health Act<br />

The Federal Mine Safety and Health Act (30 U.S.C. sec. 801 et seq.) was enacted<br />

in 1977 and ameDdcd several times. most recently in 1992. Its purpose is to develop and<br />

enforce health and safety standards and regulations for mine workers. The Mine Safety<br />

and Health Administration (MSHA) sets health and safety regulations for equipment and<br />

operations used in all subsurface mining activities. These regulations are codified in 30<br />

CPR Pans 40 to 100. This act has no jurisdiction at oil and gas extraction sites.<br />

Operations that involve subsurface mining <strong>of</strong> potash may be subject to the<br />

following MSHA safety regulations in 30 CPR:<br />
