Pennits. special reports. and fees<br />

A permit is required as described in 50 CFR Part 22 for the taking, possession,<br />

and transponation <strong>of</strong> bald or golden eagles or their parts, nests, or eggs for the reasons<br />

cited above. No special reports are required by the regulations. A general permit<br />

application fee is required by 50 CFR, Section 13 .11.<br />

Resource Conservation and Recovery Act<br />

The Resource Conservation and Recovery Act (RCRA), 42 USC 6901-6992K, was<br />

enacted in 1976 as an amendment to the Solid <strong>Waste</strong> Disposal Act. RCRA has been<br />

amended several times, most notably in 1980 and in 1984. RCRA Subtitle C, D, and I<br />

are described below.<br />

RCRA Subtitle C - Hazardous <strong>Waste</strong><br />

RCRA Subtitle C (40 CPR Parts 260 to 271) includes the regulatory requirements<br />

for generators and transporters <strong>of</strong> hazardous waste and owners and operators <strong>of</strong> hazardous<br />

waste !reattnent, storage, and disposal (TSD) facilities. RCRA Subtitle C establishes<br />

a comprehensive "cradle-to-grave" system for regulating hazardous waste, including a<br />

manifest system for tracking hazardous wastes and a permitting system for hazardous<br />

waste treattnent, storage, or disposal facilities. In addition, it includes a framework for<br />

implementing corrective action for releases <strong>of</strong> hazardous waste.<br />

Operations that extract oil, gas, or potash may be subject to the following RCRA<br />

Drilling fluids, produced waters, and other wastes associated with the exploration,<br />

development, or production <strong>of</strong> crude oil or natural gas are specifically excluded from<br />

regulation under RCRA Subtitle C. Solid wastes produced by the extraction or beneficiation<br />

<strong>of</strong> potash are exempt from regulation by the mjnjng waste exclusion in Part<br />

261.4(b)(7).<br />
