The application is discretionary under clause 3.3.3(a) of the <strong>Waratah</strong>-<strong>Wynyard</strong><br />

Planning Scheme 2000 as although it constitutes a primary use class within the<br />

Business & Civic Zone, it partly relies on performance criteria within the Car<br />

Parking Schedule.<br />

3. Background<br />

This report assesses the proposal against the <strong>Waratah</strong>-<strong>Wynyard</strong> Planning<br />

Scheme 2000, State Policies and other relevant legislation and takes into<br />

account representations received during the public notification period.<br />

The subject property is located within the Central Business District of the<br />

town of <strong>Wynyard</strong>. The site for the proposed hydrotherapy pool comprises flat<br />

land that currently supports a residential dwelling (89m 2 ), a garage (32m 2 ),<br />

and a retail outlet (249m 2 ). The title is within proximity to existing<br />

commercially developed sites and is also close to residentially zoned and<br />

developed land. Access to the site includes street frontage to Goldie Street<br />

and a right of way access from Inglis Street.<br />

4. Statutory Requirements<br />

The application is subject to the following statutory instruments:<br />

• Land Use Planning and Approvals Act 1993<br />

• <strong>Waratah</strong> <strong>Wynyard</strong> Planning Scheme 2000<br />

5. Finances<br />

There are no financial implications arising for <strong>Council</strong> as a result of this<br />

development. If an appeal were lodged in relation to this application <strong>Council</strong><br />

would incur costs associated with defending its position.<br />

6. Discussion<br />

Application<br />

The proposal is for the construction of a Hydrotherapy Centre to include a<br />

hydrotherapy pool on land zoned as Business & Civic at 45 Goldie Street,<br />

<strong>Wynyard</strong>. The proposal involves the construction of a building to house a<br />

heated hydrotherapy pool, change rooms, spa, sauna, and a<br />

physiotherapist/masseuse consultant’s room. As well as the therapeutic<br />

services, the business will provide water safety education, private swimming<br />

instruction and water aerobic classes.<br />
