The application is discretionary under clause 3.3.3(a) of the Waratah-Wynyard
Planning Scheme 2000 as although it constitutes a primary use class within the
Business & Civic Zone, it partly relies on performance criteria within the Car
Parking Schedule.
3. Background
This report assesses the proposal against the Waratah-Wynyard Planning
Scheme 2000, State Policies and other relevant legislation and takes into
account representations received during the public notification period.
The subject property is located within the Central Business District of the
town of Wynyard. The site for the proposed hydrotherapy pool comprises flat
land that currently supports a residential dwelling (89m 2 ), a garage (32m 2 ),
and a retail outlet (249m 2 ). The title is within proximity to existing
commercially developed sites and is also close to residentially zoned and
developed land. Access to the site includes street frontage to Goldie Street
and a right of way access from Inglis Street.
4. Statutory Requirements
The application is subject to the following statutory instruments:

• Waratah Wynyard Planning Scheme 2000
5. Finances
There are no financial implications arising for Council as a result of this
development. If an appeal were lodged in relation to this application Council
would incur costs associated with defending its position.
6. Discussion
Application
The proposal is for the construction of a Hydrotherapy Centre to include a
hydrotherapy pool on land zoned as Business & Civic at 45 Goldie Street,
Wynyard. The proposal involves the construction of a building to house a
heated hydrotherapy pool, change rooms, spa, sauna, and a
physiotherapist/masseuse consultant’s room. As well as the therapeutic
services, the business will provide water safety education, private swimming
instruction and water aerobic classes.
