DEVELOPMENT COMMISSION<br />
Draft Planning Scheme amendments 2005/03, 2006/02, 2006/03, 2006/04,<br />
2006/05, 2006/06 and 2006/07 are currently awaiting processing by the<br />
Commission. Public hearing schedule for early <strong>April</strong> <strong>2007</strong>.<br />
ACTIVE PLANNING APPEALS<br />

CURRENT ENFORCEMENT ACTION UNDER SECTION 64 OF<br />
LUPAA<br />
1. Section 64 application - 712 Reservoir Drive, <strong>Wynyard</strong> for Illegal<br />
buildings, illegal landfill and illegal works to the embankment and<br />
bed of Camp Creek.<br />
An appeal hearing was part heard on 12 <strong>April</strong> 2006. The Tribunal part<br />
heard the appeal and held the matter over to allow the parties to<br />
explore a consent agreement. <strong>Council</strong>’s solicitor has advised that the<br />
consent agreement on this matter has not been resolved and the matter<br />
is to be again placed before the Tribunal.<br />
2. Section 64 application and EPN - Pages Road, illegal landfill.<br />
<strong>Council</strong>’s solicitor has advised on 7 September 2006 that the matter is<br />
being progressed to a consent agreement with the other party expected<br />
to sign off on the agreement. The Tribunal are currently processing the<br />
consent agreement.<br />
3. Section 64 application - Cardigan Street, Somerset, CT 198768/1,<br />
illegal landfill.<br />
<strong>Council</strong> are progressing a Sec 64 action in relation to illegal landfill on<br />
this residential title.<br />
<strong>Council</strong>’s solicitor has advised the matter is being progressed by the<br />
Tribunal with parties negotiating a consent agreement. It is expected<br />
that remedial works will be carried out in the next few months.<br />
