AMENDMENT – LC MACKENZIE
The General Manager informed the meeting that the applicant had provided
advice on 16 April 2007 that he was withdrawing his minor amendment
application.

1. Recommendation
That the Planning Authority refuse the application for a minor
amendment to SD1637 which would have allowed Lots 25 to 30
to be brought forward to Stage 3 of the subdivision and also
removed the requirement to drain the farm dam on the balance
land as the application does not demonstrate compliance with
Section 56 (2)(b) and (c) of the Land Use Planning and
Approvals Act 1993.
2. Summary
Introduction
This item was listed on the Planning Authority agenda for its meeting on 19
March 2007. Correspondence received from the applicant Mr Mackenzie on
the 19 March 2007 which requested that a decision on the minor amendment
application be deferred to allow additional information to be provided. The
Planning Authority determined:
That Council defer consideration of the minor amendment
application for SD1637 until the next meeting of Council, scheduled
for 16 April 2007, at which time Council is to formally determine the
matter.
The Planning Authority’s decision was communicated to Mr Mackenzie in
writing dated 21 March 2007. The Director Development Services attended
an on-site meeting with Mr Mackenzie and his Consultant Engineer on 23
March 2007.
At the time of finalising the agenda for this meeting no new additional
information has been provided which would cause an alternative
recommendation to be provided.
