8. Conclusion<br />

The proposed hydrotherapy pool is consistent with the <strong>Waratah</strong> <strong>Wynyard</strong><br />

Planning Scheme 2000. The proposal is for a primary use within the existing<br />

Business & Civic Zone. The conditions provided within the permit will ensure<br />

that the hydrotherapy pool does not pose a detrimental impact upon the<br />

amenity of surrounding land.<br />

The proposal is consistent with the values of the Business & Civic Zone,<br />

including providing a range of commercial functions of both local and regional<br />

significance. The proposed hydrotherapy pool is recommended for approval<br />

subject to the conditions provided with this permit.<br />

That the Planning Authority approve the proposed Hydrotherapy Centre to be<br />

constructed at 45 Goldie Street, <strong>Wynyard</strong>, subject to the following conditions:<br />

1. The development as shown on the endorsed plan(s) is not to be altered<br />

or modified for any reason without the consent of the Director of<br />

Development Services.<br />

2. The premises is only to be open for the use hereby permitted between<br />

the following hours:<br />

Monday to Friday - 6:00 a.m. to 9:00 p.m. inclusive<br />

Saturday - 6:00 a.m. to 9:00 p.m. inclusive<br />

Sundays and Public Holidays - 6:00 a.m. to 9:00 p.m. inclusive<br />

3. Prior to the commencement of the use the applicant is to pay to<br />

<strong>Council</strong> cash in lieu for car parking spaces not provided on site to the<br />

sum of $5,154. Calculation of Value of Cash in Lieu for the seven (7)<br />

retail spaces unable to be provided is as follows: Area of car parking<br />

spaces not provided = 100m2, divided by land area 776m2 X $40,000<br />

(unimproved capital value of land) = $5,154 cash in lieu requirement.<br />

4. At no time is the right of way marked as C, D, E & F on the title known<br />

as CT149065/1, and the right of way on the title known as CT55948/2<br />

to be obstructed by the parking of cars (except for vehicles associated<br />

with plant maintenance operations) or storage of materials either<br />

during or after the construction phase of the development.<br />

5. All deliveries to the development are to be made via the Goldie Street<br />

frontage of the premises.<br />
