Initiator of proceedings<br />

43.20. The initiator of proceedings is responsible for ensuring a fair balance in all legal<br />

proceedings conducted within the <strong>EHF</strong>. She/he may, on behalf of the <strong>EHF</strong>, initiate legal<br />

proceedings, appeal first instance decisions of the <strong>EHF</strong> administrative/legal bodies and<br />

file a claim with the <strong>EHF</strong> Court of Arbitration.<br />

<strong>EHF</strong> Court of Arbitration (ECA)<br />

43.21. Any issue decided upon by the Court of Appeal may be brought by any of the relevant<br />

parties before the <strong>EHF</strong> Court of Arbitration.<br />

43.22. The initiation of proceedings before the <strong>EHF</strong> Court of Arbitration on a specific issue<br />

does not suspend the implementation of the decision taken by the Court of Appeal on<br />

such an issue, unless decided otherwise by the <strong>EHF</strong> Court of Arbitration in accordance<br />

with the Rules of Arbitration for the ECA.<br />

43.23. The claimant shall send a written request in duplicate to the <strong>EHF</strong> Court of Arbitration<br />

Office that shall receive it no later than twenty-one (21) days after the delivery,<br />

announcement or communication of the Court of Appeal ruling to the parties.<br />

43.24. The written request shall include at least a detailed statement of claim and the<br />

nomination of one (1) arbitrator from the ECA Arbitrators List.<br />

43.25. Moreover an advance payment of € 5,000 shall be paid by the claimant to the <strong>EHF</strong><br />

Court of Arbitration no later than one (1) week after the filing of the claim. If the<br />

advance payment is not received on the <strong>EHF</strong> Court of Arbitration account in the<br />

required timeline, the claim shall be deemed withdrawn.<br />

43.26. The advance payment of € 5,000 is composed of:<br />

• € 1,500 arbitration fee<br />

• € 3,500 advance payment of the arbitration proceedings costs<br />

43.27. The proceedings are governed by the Rules of Arbitration for the ECA.<br />

43.28. Decisions of the <strong>EHF</strong> Court of Arbitration are communicated in writing to the parties.<br />

Arising costs<br />

43.29. In principle the actual costs for personnel and material arising from the activities of<br />

the Court of Appeal shall be charged in connection with the procedure. Rules governing<br />

the apportionment and payment of costs related to the <strong>EHF</strong> bodies’ legal proceedings<br />

by and between the parties are stated in article 48 of the <strong>EHF</strong> Legal Regulations.<br />
