Guidel<strong>in</strong>es for USAID Investment Assistance<br />

USAID support related <strong>to</strong> foreign <strong>in</strong>vestment<br />

must comply w<strong>it</strong>h legislative and policy<br />

guidel<strong>in</strong>es. The most important of these is<br />

ADS 225, which outl<strong>in</strong>es pr<strong>in</strong>ciples for trade<br />

and <strong>in</strong>vestment activ<strong>it</strong>ies as they affect U.S.<br />

jobs and workers’ rights and provides detailed<br />

policy, program, and implementation guidel<strong>in</strong>es<br />

for <strong>in</strong>vestment activ<strong>it</strong>ies.<br />

Issued <strong>in</strong> April 2003, ADS 225 supersedes<br />

Policy Determ<strong>in</strong>ation (PD) 20, which had<br />

been <strong>in</strong> place s<strong>in</strong>ce 1994. The new directive,<br />

ent<strong>it</strong>led “Program Pr<strong>in</strong>ciples for Trade and<br />

Investment Activ<strong>it</strong>ies and the ‘Impact on US<br />

Jobs’ and ‘<strong>Work</strong>ers’ Rights’”<br />

• Expands the list of perm<strong>it</strong>ted activ<strong>it</strong>ies,<br />

giv<strong>in</strong>g Bureaus and Missions greater<br />

lat<strong>it</strong>ude <strong>in</strong> design<strong>in</strong>g trade and <strong>in</strong>vestment<br />

activ<strong>it</strong>ies;<br />

• Refocuses the list of prohib<strong>it</strong>ed activ<strong>it</strong>ies<br />

on those that can clearly <strong>in</strong>duce a firm <strong>to</strong><br />

relocate; and<br />

• Ends the requirement for a Presidential<br />

waiver for approval <strong>to</strong> support export<br />

process<strong>in</strong>g zones (EPZs).<br />

Accord<strong>in</strong>g <strong>to</strong> the General Notice announc<strong>in</strong>g<br />

<strong>it</strong>, ADS 225 “balances USAID’s objectives of<br />

promot<strong>in</strong>g economic development w<strong>it</strong>h the<br />

sense of Congress that bilateral assistance<br />

should not be used <strong>to</strong> <strong>in</strong>duce U.S. firms <strong>to</strong><br />

relocate abroad, result<strong>in</strong>g <strong>in</strong> the loss of U.S.<br />

jobs.”<br />

To do this, the ADS classifies trade and<br />

<strong>in</strong>vestment activ<strong>it</strong>ies as perm<strong>it</strong>ted, prohib<strong>it</strong>ed<br />

and “gray area” activ<strong>it</strong>ies. Gray area activ<strong>it</strong>ies<br />

are generally perm<strong>it</strong>ted if no negative impact<br />

on U.S. jobs is likely (as determ<strong>in</strong>ed by ADS<br />

standards), and if activ<strong>it</strong>ies are designed and<br />

implemented so as <strong>to</strong> not conta<strong>in</strong> or evolve<br />

<strong>in</strong><strong>to</strong> prohib<strong>it</strong>ed activ<strong>it</strong>ies. Summarized here<br />

are some of the examples ADS 225 provides<br />

for each category of activ<strong>it</strong>y. Please refer <strong>to</strong><br />

the ADS for the exact language.<br />

Perm<strong>it</strong>ted<br />

• Policy dialogue<br />

• Legal, regula<strong>to</strong>ry, and judicial reform projects<br />

• Dissem<strong>in</strong>ation and analysis of general<br />

economic and bus<strong>in</strong>ess <strong>in</strong>formation<br />

• Enhanc<strong>in</strong>g the compet<strong>it</strong>iveness of local<br />

producers<br />

• Strengthen<strong>in</strong>g bus<strong>in</strong>ess and free trade<br />

associations<br />

• Basic cap<strong>it</strong>al projects, and cred<strong>it</strong> and<br />

micro- and small enterprise development<br />

• Agricultural projects address<strong>in</strong>g food<br />

secur<strong>it</strong>y needs<br />

• Trade capac<strong>it</strong>y build<strong>in</strong>g and trade facil<strong>it</strong>ation<br />

• Technical assistance relat<strong>in</strong>g <strong>to</strong><br />

privatization and core labor standards<br />

Prohib<strong>it</strong>ed<br />

• F<strong>in</strong>ancial <strong>in</strong>centives <strong>to</strong> relocate<br />

• Investment promotion missions <strong>to</strong> the<br />

Un<strong>it</strong>ed States <strong>to</strong> <strong>in</strong>duce U.S. firms <strong>to</strong><br />

relocate<br />

• Advertis<strong>in</strong>g <strong>in</strong>tended <strong>to</strong> encourage U.S.<br />

Gray Area<br />

• Establish<strong>in</strong>g <strong>in</strong>vestment promotion offices<br />

and f<strong>in</strong>anc<strong>in</strong>g <strong>in</strong>vestment promotion<br />

activ<strong>it</strong>ies <strong>in</strong> the host country<br />

• Activ<strong>it</strong>ies <strong>in</strong>volv<strong>in</strong>g EPZs<br />

• Feasibil<strong>it</strong>y studies and travel and technical<br />

assistance for firms contemplat<strong>in</strong>g or<br />

plann<strong>in</strong>g <strong>in</strong>vestments <strong>in</strong> the host country<br />

The specific provisions of the ADS provide<br />

more examples, analytical procedures, and<br />

assistance clauses for gray area activ<strong>it</strong>ies, and<br />

further policy and def<strong>in</strong><strong>it</strong>ions. USAID staff<br />

should seek legal counsel for any FDI-related<br />

activ<strong>it</strong>y <strong>to</strong> ensure compliance w<strong>it</strong>h ADS 225.<br />
