<strong>SECNAVINST</strong> <strong>1412.9B</strong>7 Feb 2006(c) Reserve CWO4s who twice fail selection to CWO5may be continued beyond 30 years qualifying service subject tothe needs of the Selected Reserve. This provision does notapply to CWO4s required to separate due to age or failure tomeet minimum participation requirements.(d) Reserve CWO4s on active duty with the AR programwho twice fail selection to CWO5 may be continued untilcompletion of 20 years active duty, so long as they continue tobe selected for retention on active duty by an AR board. Suchofficers not selected will be released from active duty.(3) CWO3, CWO2. Unless retired or separated under someother provision of law or policy, a Reserve CWO3 or CWO2 who hastwice failed of selection for promotion to the next warrantofficer grade and who has:(a) Performed more than 20 years of active serviceor who has performed at least 20 years of service computed undersection 12732 of reference (a) on either the date when theSECNAV approves the report of the promotion selection board; orthe date when his or her name was removed from a promotion list,whichever applies, shall be transferred to the inactive statuslist, or upon his or her request, to the <strong>Marine</strong> <strong>Corps</strong> Reserveretired list.(b) Performed at least 18 but less than 20 years ofservice computed under section 12732 of reference (a) on thedate when SECNAV approves the report of the promotion selectionboard or the date when his or her name was removed from thepromotion list, whichever applies, shall not be discharged ortransferred from an active status without his or her consentbefore the earlier of the following dates unless soonerseparated for cause:1. The date on which he or she is entitled tobe credited with 20 years of service computed under section12732 of reference (a); or2. If he or she has at least 19 years ofservice, computed under section 12732 of reference (a), thesecond anniversary of the date on which he or she wouldotherwise be discharged or transferred from an active status; or3. If he or she has at least 18 but less than19 years of service, computed under section 12732 of reference15Enclosure (2)
