<strong>SECNAVINST</strong> <strong>1412.9B</strong>7 Feb 2006g. CMC shall forward the report of the promotion selectionboard and nomination for appointment of the selected officers toNJAG for legal review prior to submission to SECNAV. Perreference (l), the LDO lieutenant colonel promotion selectionboard shall provide the Under Secretary of Defense forAcquisition, Technology, and Logistics a statistical comparisonof acquisition corps and LDO promotion selection rates inaccordance with the selection guidance established under section1731(b) of reference (a).h. If, after reviewing the report of a promotion selectionboard, SECNAV determines that the board acted contrary to law orregulation, SECNAV shall return the report to the board forfurther proceedings. Upon receipt of a report that has beenreturned by SECNAV for further proceedings, the board (or asubsequent promotion selection board for the same grade andcompetitive category) shall conduct such proceedings as may benecessary in order to revise the report and shall resubmit thereport, as revised, to SECNAV in accordance with the provisionsof this enclosure for the original submission of promotionselection board reports to SECNAV.i. When the report of the LDO promotion selection board isapproved by PDUSD (P&R) and the chief warrant officer andReserve chief warrant officer reports are approved by SECNAV,the names of the officers approved for promotion shall be placedon a single promotion list for each grade and competitivecategory, in order of seniority of such officers on theirrespective active-duty list.(1) SECNAV shall nominate the names of the officers onthe LDO promotion list to the Senate and the chief warrantofficers to the President, via the Deputy Secretary of Defense,for appointment to their selected grades.(2) In an effort to consolidate actions, the activechief warrant officer nominations submitted to the Presidentshall also contain the names of those W-1s anticipated to bepromoted within the same fiscal year as the officers recommendedfor promotion by the selection board.(3) SECNAV may, if it is deemed appropriate when thereare unresolved allegations concerning a nominated officer’squalifications for promotion, withhold the officer’s from thelist of names submitted to the Senate or President, as7Enclosure (4)
