If the officerdeclines to make a statement, the officer concerned shall submita signed statement to that effect.(c) Supporting rationale for delay from theofficer’s commanding officer based on his or her knowledge ofthe officer involved.(d) A recommendation by CMC.c. Notification of Grounds for Delay. The promotion of anofficer may be delayed only if the officer has been givenwritten notice of the grounds for the delay before the effectivedate of the promotion, unless it is impractical to do so, inwhich case such written notice shall be given as soon aspracticable.d. Limitations on Delay. The promotion of an officer maynot be delayed for more than six months after the date on whichthe officer would otherwise have been promoted, unless SECNAVspecifies a further period of delay. CMC will submit timelyrequests, with supporting rationale, for any extension of delayof promotion. An officer’s promotion may not be delayed morethan 90 days after final action has been taken in any criminalcase against the officer in a Federal or State court, more than90 days after final action has been taken in any court-martialagainst the officer, or more than 18 months after the date onwhich the officer would otherwise have been promoted, whicheveris later.e. Removal from the Promotion List. If during a delay ofpromotion, it is determined that removal from the promotion listis appropriate, removal action under paragraph 14 of thisenclosure may be initiated. Although removal action iscontemplated, requests for delay extensions as provided inparagraph 13d shall be submitted to SECNAV as necessary untilthe officer’s name is removed from the promotion list.10Enclosure (4)
