Requests fordeclination must be submitted to Commandant of the <strong>Marine</strong> <strong>Corps</strong>,<strong>Headquarters</strong> U.S. <strong>Marine</strong> <strong>Corps</strong> (MMPR-1), Harry Lee Hall, 17Lejeune Road, Quantico, VA 22134-5104. The appointment will bedeemed effective unless the request for declination is receivedby the 30th day after the effective date. Additionally, anystatement or action by an officer that signals their acceptanceof the appointment, forever waives their right to decline. Seeparagraph 14 of this enclosure for additional guidancepertaining to declination of appointment.13. Delay of Promotion. Prior to effecting a promotion, CMC,his designee, or commanding officers exercising special courtmartialconvening authority may delay an officer's promotion.If the promotion is delayed, the delaying officer shall, within10 days, or as soon as practicable, forward the informationrequired by paragraph 13b to SECNAV for ratification.a. Criteria for Promotion Delay. Promotion may be delayedunder this instruction if:(1) Sworn charges against the officer have been receivedby an officer exercising general court-martial jurisdiction overthe officer and such charges have not been disposed of.(2) An investigation is being conducted to determinewhether disciplinary action of any kind should be broughtagainst the officer.(3) Processing for separation for cause has beeninitiated under reference (i).(4) A criminal proceeding in a Federal or State court ispending against the officer.(5) There is cause to believe that the officer ismentally, physically, morally, or professionally unqualified.Officers with physical disabilities received in the line of dutywho have been retained in an active status or whose medicalconditions are in the process of being reviewed for retentionshall not be denied promotion.b. Command Requests for Delay(1) Commanding officers who consider delay of anofficer’s promotion warranted and delay an officer’s promotion,shall submit justification for the delay to SECNAV, via CMC9Enclosure (4)
