Customs Code of Republic of Albaniaa) aircraft flying from one airport to anotherin the Republic of Albania without anystops at an airport outside the republic ofAlbania on condition that such means donot transport goods subject to thecustoms control and surveillance;b) military aircraft;c) private aircraft for personal use whensuch means does not carry goods subjectto customs control and surveillance.Article 48(The extension of control)The customs authorities of arrival shall carryout customs supervision of the aircraftimmediately on landing and conduct anycontrols and formalities applicable to:a) the cabin and baggage of the crew;b) passengers baggage and hand luggage.Article 49(The control of aircraft departing)Customs supervision and control of an aircraft,crew, cabin crew, passengers and theirluggage, and goods departing to a destinationoutside the territory of the Republic of Albaniashall be carried out at the airport authorized forinternational departures.Article 50(The emergency landing)If, in cases of emergency or force majeure, anaircraft has to land at an airport not authorizedfor receiving international air traffic, thecaptain of the aircraft shall inform the nearestcustoms authority which shall place theaircraft, crew, passengers and goods undercustoms control and supervision.C. Maritime and Water TrafficArticle 51(Places to encore)1. Vessels carrying goods brought into thecustoms territory of the Republic of Albaniamay only call ports approved for internationaltraffic.2. In cases of emergency or force majeure,vessels referred to in paragraph 1 of thisArticle may also call at other points where thecaptain of the vessel shall inform the nearestcustoms office or the nearest governmentauthority, which shall report immediately tothe nearest customs authority.Article 52(The manifest of goods)1. Vessels carrying goods brought into orleaving the customs territory of the Republic ofAlbania and sailing in the customs border zoneat sea, on navigable lakes or rivers shall carry amanifest of goods referred to in Article 41(2),unless provided otherwise.2. Another document or collection ofdocuments containing the informationprescribed for the manifest may be accepted asa manifest according to the ImplementingProvisions of this Code.3. The following vessels need not carry amanifest:a) vessels used for scientific purposes;b) fishing vessels used only for fishing;c) sports vessels and private boats oncondition that they do not transport goodssubject to customs control. .Article 53(Customs surveillance)1. Customs surveillance starts immediatelyafter the vessel is anchored, arrives at the roadstead or harbor until the moment when thegoods are unloaded from the vessel andassigned a customs approved treatment or use.2. Customs Code of Republic of Albania(The lodgment of manifest)Within 24 hours from the arrival of the vesselat the road stead or harbor the of captain of thevessel should present at the customs authoritiesthe manifest of goods according to theprocedures laid down in the ImplementingProvisions of this Code.Article 55(Transshipment of goods)1. Transshipment of goods from one vessel toanother shall be approved by the customsauthorities and shall be carried out undercustoms supervision.2. In cases of unforeseeable circumstances,goods may be transshipped from one vessel toanother without the approval of the customsauthorities. In such cases, the captain of thevessel should request from the competentseaport or harbor authority a report as to thereasons for the transshipment. This documentis presented immediately to the competentcustoms authorities.3. The competent customs authorities thatreceive the report will make sure that there areno customs violations involved. In that case,they will take the appropriate decisionsaccording to what is provided for in Title VIIIof the Code.Article 56(Movement via lakes and rivers)Vessels bringing or sending away goods fromthe customs territory of the Republic ofAlbania via lakes and rivers may arrive ordepart only from points authorized by thecustoms authorities. These vessels are subjectof the same formalities referred to in Articles51 to 55 of this Code.Article 57(Exemption from customs control)Foreign vessels in transit which call at anAlbanian lake or river port to take fuel, food,or other supplies, but not to take on or unloadcargo, are exempt from customs inspection andshall only be placed under customssupervision.Article 581. Albanian vessels in scheduled servicebetween two border customs zones within theAlbanian customs territory, authorized fortransport of goods and passengers, do not needpresent a manifest of goods provided for thatthey are not subject of customs control andsurveillance.2. In any case, the customs authorities maycarry out in the customs areas of surveillanceall the necessary controls to verify eventualviolations of the dispositions of this Code andits Implementing Provisions.D. Rail TrafficArticle 591. The railway company, which accepts toenter the goods, transported by railway in thecustoms territory of the Republic of Albania;accompanied by a consignment note shall bethe responsible body for customs formalities.2. The railway company shall make all therecords held at the accounting offices availableto the Customs Administration, related totransported goods.3. In the transport of passengers by railway,the customs authorities will carry out all thecontrols in the land railway border crossingpoints on the passengers and their luggage, aswell as in the conducting cabins, personnel,and their luggage.E. Postal GoodsArticle 601. All mail containing consignments forcommercial purposes as well as mailcontaining consignments of an aggregatevalue, for each consignment exceeding thethreshold laid down by the provisions in forceissued by the Minister of Finance, are subjectto a customs declaration.2. Postal goods shall be accepted anddelivered between a foreign post office and theAlbanian post office under customssupervision.
