Any person satisfying the conditions laiddown in paragraph 2 may, subject to the limitslaid down in paragraph 3, obtain from thecustoms authorities a guarantee waiver fortransit operations carried out by him.2. The guarantee waiver referred to inparagraph 1 shall be granted only to persons:a) who are established in the Republic ofAlbania;b) who are regular users of the transitprocedure;c) whose financial situation is such thatthey can meet their commitments;d) who have not committed anyinfringement of customs or fiscal laws;ande) who, in accordance with the determinedspecimen form, undertake to pay, uponthe first application in writing by thecustoms authorities, any sums claimedin respect of their transit operations.3. The guarantee waiver granted in accordancewith paragraphs 1 and 2 shall not apply totransit operations involving goods:a) of total value exceeding an amountdetermined in accordance with theImplementing Provisions of this Code; orb) which present increased risks because ofthe level of import duties, to which theyare subject in the Republic of Albania.4. The General Directorate of Customs, whichgrants the waiver, shall issue to each personobtaining it one or more copies of a guaranteewaiver certificate.Article 1191. The principal shall be the subject of thetransit procedure. He shall be responsible for:a) presentation of the goods intact at thecustoms office of destination by theprescribed time limit and with dueobservance of the measures adopted bythe customs authorities to ensureidentification;b) observance of the provisions related tothe transit procedure.2. Notwithstanding the principal’s obligationsreferred to in paragraph 1, the carrier orrecipient of goods knowing they are movingunder transit shall also be responsible forpresentation of the goods intact at the customsoffice of destination by the prescribed timelimit and with due observance of the measuresadopted by the customs authorities to ensureidentification.Article 1201. The detailed rules for the operation of thesaid procedure and the respective exemptionsshall be determined in provisions laid down inthe Implementing Provisions of this Code.2. Provided that the implementation ofmeasures applying to goods is guaranteed, theMinister of Finance is entitled to establishsimplified procedures in certain circumstancesfor goods not required to move on the territoryof another country.C. Customs warehousesArticle 1211. The customs warehousing procedure shallallow the storage in a customs warehouses ofthe:a) non-Albanian goods, without such goodsbeing subject to import duties orcommercial policy measures;b) Albanian goods, where legislationgoverning specific fields provides thattheir being placed in a customswarehouse shall attract the application ofmeasures normally attaching to theexport of such goods.2. ‘Customs warehouse’ means any placeapproved by and under the supervision of the\\Ds2\admin\Kareem - Online Library Rebuild (Do Not Delete)\Pending\Albania\Customs Code of Albania (eng).doc

Cases in which the goods referred to inparagraph 1 may be placed under the customswarehousing procedure without being stored ina customs warehouse shall be determined byspecial provisions enacted by the Minister ofFinance.Article 1221. A customs warehouse may be either apublic warehouse or a private warehouse:a) ‘public warehouse’ means a customswarehouse available for use by anyperson for the warehousing of goods;b) ‘private warehouse’ means a customswarehouse reserved only for thewarehousing of goods by thewarehousekeeper.2. ‘The warehousekeeper’ is the personauthorized by the customs administration tooperate the customs warehouse.3. ‘The depositor’ shall be the person boundby the declaration placing the goods under thecustoms warehousing procedure or to whomthe rights and obligations of such a personhave been transferred.Article 1231. Operation and use of a customs warehouseshall be subject to the issue of an authorizationby the customs authorities, unless the saidauthorities operate the customs warehousethemselves.2. Any person wishing to operate a customswarehouse must make a request in writingcontaining the information required forgranting the authorization, in particulardemonstrating that an economic need forwarehousing exists. The authorization shall laydown the conditions for operating the customswarehouse.3. The authorization shall be issued only topersons established in the Republic of Albania.Article 124The warehouse keeper shall be responsible for:a) ensuring that while the goods are in thecustoms warehouse they are not removedfrom customs supervision;b) fulfilling the obligations that arise fromthe storage of goods covered by thecustoms warehousing procedure; andc) complying with the particular conditionsspecified in the authorization.Article 1251. By way of derogation from Article 124,where the authorization concerns a publicwarehouse, it may provide that theresponsibilities referred to in Article 124 (a)and/or (b) devolve exclusively upon thedepositor.2. The depositor shall at all times beresponsible for fulfilling the obligations arisingfrom the placing of goods under the customswarehousing procedure.Article 126The rights and obligations of awarehousekeeper may, with the agreement ofthe customs authorities, be transferred toanother person.Article 127Without prejudice to Article 111, the customsauthorities may require that thewarehousekeeper provide a guaranteeconcerning the responsibilities specified inArticle 124.Article 1281. The person designated by the customsauthorities shall keep stock records of all thegoods placed under the customs warehousingprocedure in a form approved by thoseauthorities.2.
