6. have an opportunity to hear all information presented against him orher/the organization and to question adverse witnesses personally,but not through legal counsel or the advisor;7. be provided a written statement of the facts which shall be determinedand based solely on what is presented at the hearing;8. have the right to examine the results and findings of the hearing; and9. have the right to make a record of the hearing at his or her/the organization’sexpense.OTE:A written request to record the hearing must be submitted at least 72hours before the hearing.APPELLATE PROCEDURESPetition to AppealA student shall be granted an opportunity to petition for an appeal hearingto the Director of <strong>Student</strong> Activities and Organizations within forty-eight(48) hours after notification of the Executive Judicial Panel’s or the <strong>University</strong>Judiciary Committee’s decision of his or her case.The Director of <strong>Student</strong> Activities and Organizations determines whetherthe appeal shall be forwarded to the Juridical Appeals Committee based onsufficient reason(s) indicated in the written petition. Sufficient reason(s)shall be new evidence, discrepancies in the judicial procedures, and/or inappropriatesanction or unfairness.Judicial Appeals Committee members cannot be persons who served on theoriginal hearing board. The Appeals Committee shall, by majority vote,grant a hearing, or deny the appeal. If the hearing is granted, the appeal maybe (1) denied, upholding the sanction, (2) granted and a new hearing ordered,or (3) granted and the sanction changed. The Appeals Committee islimited to ordering a new hearing to the extent that, in their judgment, adefect in the original hearing is found which was sufficiently substantial tohave changed the outcome in a significant manner.Appeal ProceduresIf an appeal is granted by the Judicial Appeals Committee, the proceduresshall be as follows:111
