observations with respect to categories <strong>in</strong>clud<strong>in</strong>g language <strong>in</strong>terpretation, technical<br />

quality, access to counsel, and presentation <strong>of</strong> evidence. Although we attempted to<br />

observe hear<strong>in</strong>gs at both ends – <strong>in</strong> <strong>the</strong> immigration court and at <strong>the</strong> remote site where <strong>the</strong><br />

deta<strong>in</strong>ed immigrants are be<strong>in</strong>g held – <strong>the</strong> <strong>of</strong>fice <strong>of</strong> Immigration and Customs<br />

Enforcement (ICE) strongly “recommended” to us that non-attorneys not attempt to view<br />

hear<strong>in</strong>gs at <strong>the</strong> remote site, s<strong>in</strong>ce <strong>the</strong>y might be “turned away due to a lack <strong>of</strong> space.” 8<br />

To supplement our data, we <strong>in</strong>terviewed immigration practitioners about <strong>the</strong>ir<br />

experience with videoconference hear<strong>in</strong>gs. We asked EOIR for permission to <strong>in</strong>terview<br />

Immigration Judges. EOIR decl<strong>in</strong>ed our request but did respond to a set <strong>of</strong> written<br />

questions we submitted concern<strong>in</strong>g videoconferenc<strong>in</strong>g. We also attempted to <strong>in</strong>terview<br />

deta<strong>in</strong>ed immigrants but with little success. Because immigrants have no right to<br />

appo<strong>in</strong>ted counsel, many proceed through <strong>the</strong>ir removal hear<strong>in</strong>g unrepresented. For this<br />

reason, we believed it was important to speak to immigrants directly about <strong>the</strong>ir<br />

experiences with this new system. It was difficult to contact deta<strong>in</strong>ees because <strong>the</strong>y<br />

cannot receive <strong>in</strong>com<strong>in</strong>g phone calls, and <strong>the</strong>y can only place outgo<strong>in</strong>g calls collect. 9 In<br />

early February 2005, we sent letters to <strong>in</strong>dividual deta<strong>in</strong>ees at <strong>the</strong> Kenosha County<br />

Detention Center (most <strong>of</strong> whom had asked to meet with us), advis<strong>in</strong>g <strong>the</strong>m that we<br />
