Master Calendar hear<strong>in</strong>g. Bond hear<strong>in</strong>gs are <strong>of</strong> great importance to an immigrant.<br />

Release on bond can mean <strong>the</strong> difference between hav<strong>in</strong>g one’s freedom and be<strong>in</strong>g able<br />

to prepare a defense, and try<strong>in</strong>g to stave <strong>of</strong>f removal from detention, spend<strong>in</strong>g months,<br />

even years <strong>in</strong> a jail cell, at a significant distance from family and counsel. Second, judges<br />

<strong>of</strong>ten make rul<strong>in</strong>gs at Master Calendar hear<strong>in</strong>gs that dispose <strong>of</strong> a case, <strong>in</strong>clud<strong>in</strong>g rul<strong>in</strong>gs<br />

on complex legal issues regard<strong>in</strong>g <strong>in</strong>admissibility or deportability, or f<strong>in</strong>d<strong>in</strong>gs that an<br />

immigrant is <strong>in</strong>eligible for any relief before <strong>the</strong> Court. Moreover, it is not uncommon for<br />

Immigration Judges to make factual f<strong>in</strong>d<strong>in</strong>gs at Master Calendar hear<strong>in</strong>gs, even though<br />

<strong>the</strong>re is no authority for treat<strong>in</strong>g Master Calendar hear<strong>in</strong>gs as evidentiary hear<strong>in</strong>gs.<br />

Immigration Judges can – and do – enter f<strong>in</strong>al orders <strong>of</strong> removal at Master Calendar<br />

hear<strong>in</strong>gs.<br />

Videoconference Hear<strong>in</strong>gs <strong>in</strong> <strong>the</strong> Chicago Immigration Court<br />

The Chicago videoconference court does not look like o<strong>the</strong>r courtrooms. Located<br />

on <strong>the</strong> n<strong>in</strong>eteenth floor <strong>of</strong> an <strong>of</strong>fice tower, <strong>the</strong> courtroom looks noth<strong>in</strong>g like <strong>the</strong> stark and<br />

formal chambers <strong>of</strong> <strong>the</strong> nearby Dirksen Build<strong>in</strong>g (federal court) or <strong>the</strong> Daley Center (state<br />

court). The judge’s “bench” is really just a table. The attorney for <strong>the</strong> government (<strong>the</strong><br />

“trial attorney”) and <strong>the</strong> attorney for <strong>the</strong> immigrant sit fac<strong>in</strong>g each o<strong>the</strong>r at tables adjacent<br />

to <strong>the</strong> bench, with<strong>in</strong> reach <strong>of</strong> <strong>the</strong> television. The Chicago videoconference court has a<br />

copy mach<strong>in</strong>e, pr<strong>in</strong>ter, and ample <strong>of</strong>fice supplies. A fax mach<strong>in</strong>e did not exist <strong>in</strong> <strong>the</strong><br />

Chicago courtroom or at <strong>the</strong> remote site dur<strong>in</strong>g <strong>the</strong> time we observed hear<strong>in</strong>gs.<br />

A Spanish-speak<strong>in</strong>g <strong>in</strong>terpreter sometimes sits at <strong>the</strong> immigrant attorney’s table,<br />

translat<strong>in</strong>g exactly what <strong>the</strong> judge tells him or her to translate and noth<strong>in</strong>g more. The<br />

<strong>in</strong>terpreter <strong>of</strong>ten serves as a de facto clerk <strong>of</strong> <strong>the</strong> Immigration Court, pass<strong>in</strong>g files to <strong>the</strong><br />
