In o<strong>the</strong>r adm<strong>in</strong>istrative hear<strong>in</strong>gs, such as videoconference hear<strong>in</strong>gs held by <strong>the</strong> Social<br />

Security Adm<strong>in</strong>istration, an adm<strong>in</strong>istrative <strong>of</strong>ficer is stationed at <strong>the</strong> remote site.<br />

Immigrants may understand <strong>the</strong> nature <strong>of</strong> a videoconferenc<strong>in</strong>g hear<strong>in</strong>g better where court<br />

personnel are available at <strong>the</strong> remote site, and EOIR will have better control over<br />

problems aris<strong>in</strong>g dur<strong>in</strong>g <strong>the</strong> proceed<strong>in</strong>gs.<br />

Additionally, ICE relies on lack <strong>of</strong> space at Broadview as grounds for exclud<strong>in</strong>g<br />

<strong>the</strong> public from <strong>the</strong> remote site (contrary to applicable regulations), although it claims to<br />

have plans to “reconfigure” Broadview at some <strong>in</strong>def<strong>in</strong>ite time <strong>in</strong> <strong>the</strong> future. Public<br />

access is a critical safeguard <strong>in</strong> our judicial system and helps preserve <strong>the</strong> <strong>in</strong>tegrity <strong>of</strong> our<br />

courts. EOIR should take immediate steps to ensure that public access exists.<br />

Recommendation: Where <strong>the</strong> remote site is an ICE detention center, EOIR<br />

should create greater <strong>in</strong>dependence between itself and ICE by station<strong>in</strong>g court personnel<br />

at <strong>the</strong> remote site. EOIR should take whatever steps necessary to ensure immediate<br />

public access to Broadview, and ICE should permit immigrants to speak to <strong>the</strong> general<br />

public about <strong>the</strong>ir experiences with videoconferenc<strong>in</strong>g.<br />

8. Provide adequate notice<br />

Notice <strong>of</strong> a removal hear<strong>in</strong>g must reach <strong>the</strong> immigrant <strong>in</strong> advance <strong>of</strong> <strong>the</strong><br />

scheduled hear<strong>in</strong>g, and should provide more <strong>in</strong>formation about <strong>the</strong> videoconferenc<strong>in</strong>g<br />

hear<strong>in</strong>g process itself. As a model, EOIR should look to notice <strong>of</strong> videoconference<br />

hear<strong>in</strong>gs provided by <strong>the</strong> Social Security Adm<strong>in</strong>istration <strong>in</strong> adm<strong>in</strong>istrative disability<br />

determ<strong>in</strong>ation proceed<strong>in</strong>gs. 76 When <strong>the</strong> Social Security Adm<strong>in</strong>istration proposes to hold<br />

a videoconferenc<strong>in</strong>g hear<strong>in</strong>g, it sends a notice expla<strong>in</strong><strong>in</strong>g to <strong>the</strong> applicant how <strong>the</strong><br />
