6. Improv<strong>in</strong>g technology<br />

Many <strong>of</strong> <strong>the</strong> technical problems we found, such as image freezes, transmission<br />

delays, and poor sound quality, could be resolved with better technology. Larger video<br />

screens would make it easier for <strong>the</strong> parties to see each o<strong>the</strong>r and for immigrant deta<strong>in</strong>ees<br />

to feel more <strong>in</strong>volved <strong>in</strong> <strong>the</strong>ir removal hear<strong>in</strong>gs. In addition, some <strong>of</strong> <strong>the</strong> <strong>in</strong>terpretation<br />

problems that we observed could be ameliorated with better <strong>in</strong>terpretation technology.<br />

Improved technology might also alleviate some <strong>of</strong> <strong>the</strong> evidentiary problems we<br />

observed. In particular, we saw cases <strong>in</strong> which immigrants had not received documents<br />

or had difficulties see<strong>in</strong>g documents on <strong>the</strong> television screen. Attorneys also reported<br />

that <strong>the</strong> current fax system is riddled with problems – if, for example, <strong>the</strong>y faxed ten<br />

pages to Broadview, only seven would actually arrive. Additionally, no fax mach<strong>in</strong>e is<br />

located <strong>in</strong> <strong>the</strong> courtroom at <strong>the</strong> remote site. The ability to present and review documents<br />

is an essential component <strong>of</strong> immigrants’ due process rights, and a better facsimile<br />

system could go far towards protect<strong>in</strong>g <strong>the</strong>se rights.<br />

Recommendation: EOIR should <strong>in</strong>vest <strong>in</strong> larger video screens and <strong>in</strong>stall high-<br />

quality fax mach<strong>in</strong>es <strong>in</strong> both <strong>the</strong> courtroom and at <strong>the</strong> remote site. EOIR should seek out<br />

<strong>the</strong> most sophisticated technology, especially for <strong>in</strong>terpretation systems, which are<br />

essential for many immigrants. In order to f<strong>in</strong>d <strong>the</strong> best possible technologies, EOIR<br />

should look to o<strong>the</strong>r courts for models.<br />

7. Provid<strong>in</strong>g a better remote facility<br />

Many <strong>of</strong> <strong>the</strong> problems related to <strong>the</strong> transfer <strong>of</strong> documents that we observed could<br />

be resolved if EOIR ma<strong>in</strong>ta<strong>in</strong>ed better control over <strong>the</strong> remote site, <strong>in</strong>clud<strong>in</strong>g hav<strong>in</strong>g a<br />

tra<strong>in</strong>ed clerk stationed <strong>the</strong>re. At present, ICE guards, who are untra<strong>in</strong>ed <strong>in</strong> court<br />

procedure and are not employees <strong>of</strong> EOIR, essentially serve as clerks at <strong>the</strong> remote site.<br />
