Where immigrants are entitled to a hear<strong>in</strong>g before an immigration judge, removal<br />

proceed<strong>in</strong>gs are commenced by <strong>the</strong> service <strong>of</strong> a charg<strong>in</strong>g document, called a “Notice to<br />

Appear” (NTA). 39 Follow<strong>in</strong>g service with this document, <strong>the</strong> immigrant is summoned to<br />

appear at a prelim<strong>in</strong>ary hear<strong>in</strong>g, called a “Master Calendar” hear<strong>in</strong>g. In spite <strong>of</strong> <strong>the</strong><br />

complexity <strong>of</strong> immigration law, <strong>the</strong>re is no right to counsel paid for by <strong>the</strong> government <strong>in</strong><br />

immigration proceed<strong>in</strong>gs, and many immigrants are unrepresented. After one or more<br />

Master Calendar hear<strong>in</strong>gs, an immigrant may (if eligible for some relief) be scheduled for<br />

an “Individual Calendar,” or merits hear<strong>in</strong>g, which is a f<strong>in</strong>al evidentiary hear<strong>in</strong>g.<br />

Deta<strong>in</strong>ed immigrants with<strong>in</strong> <strong>the</strong><br />

jurisdiction <strong>of</strong> <strong>the</strong> Chicago court <strong>of</strong>ten do not<br />

receive advance written notice <strong>of</strong> <strong>the</strong>ir first<br />

receive <strong>in</strong>sufficient advance notice <strong>of</strong><br />

<strong>the</strong> hear<strong>in</strong>g, and no notice that <strong>the</strong>ir<br />

hear<strong>in</strong>g will take place through<br />

videoconferenc<strong>in</strong>g.<br />

directly to <strong>the</strong> immigrant at his or her place <strong>of</strong> detention, but to <strong>the</strong> Chicago ICE <strong>of</strong>fice,<br />

which ICE lists as <strong>the</strong> immigrant’s address for all deta<strong>in</strong>ed NTAs filed with <strong>the</strong><br />

Immigration Court. ICE asserts that it provides this notice to deta<strong>in</strong>ed immigrants on <strong>the</strong><br />

morn<strong>in</strong>g <strong>of</strong> <strong>the</strong>ir first court appearance, when <strong>the</strong>y are awakened as early as 3:00 a.m. to<br />

be transported to <strong>the</strong> remote videoconferenc<strong>in</strong>g hear<strong>in</strong>g room <strong>in</strong> Broadview, a Chicago<br />

suburb. 40 As a result, immigrants receive <strong>in</strong>sufficient advance notice <strong>of</strong> <strong>the</strong> hear<strong>in</strong>g, and<br />

no notice that <strong>the</strong>ir hear<strong>in</strong>g will take place through videoconferenc<strong>in</strong>g.<br />
