The attorneys we <strong>in</strong>terviewed expla<strong>in</strong>ed advocate-client communication <strong>in</strong> <strong>the</strong> old<br />
system to show how videoconference hear<strong>in</strong>gs have made communication more difficult.<br />
Because removal cases for this region (Ill<strong>in</strong>ois, Indiana, and Wiscons<strong>in</strong>) are heard <strong>in</strong><br />
Chicago, immigrants rout<strong>in</strong>ely seek assistance from Chicago-based attorneys. ICE<br />
deta<strong>in</strong>s immigrants <strong>in</strong> distant facilities, however, so it is rare for Chicago lawyers to<br />
consult with <strong>the</strong>ir clients <strong>in</strong> person before <strong>the</strong> hear<strong>in</strong>g. Under <strong>the</strong> pre-videoconferenc<strong>in</strong>g<br />
system, Chicago attorneys could meet with <strong>the</strong>ir clients <strong>in</strong> ICE visitation rooms at <strong>the</strong><br />
courthouse immediately before <strong>the</strong> hear<strong>in</strong>g began. Because ICE now br<strong>in</strong>gs deta<strong>in</strong>ed<br />
immigrants to a locked facility <strong>in</strong> suburban Broadview, ra<strong>the</strong>r than to court <strong>in</strong> downtown<br />
Chicago, attorneys are unable to speak privately with <strong>the</strong>ir clients before <strong>the</strong> actual<br />
hear<strong>in</strong>g. One attorney expla<strong>in</strong>ed, “No [deta<strong>in</strong>ee] is kept near an attorney. My client is<br />
be<strong>in</strong>g held <strong>in</strong> Kenosha [Wiscons<strong>in</strong>, about 1.5 hours from Chicago], but some people are<br />
held 3 to 4 hours away. Representation is becom<strong>in</strong>g more and more difficult.”<br />
Thus, <strong>the</strong> first impediment to sufficient and proper representation, once counsel is<br />
obta<strong>in</strong>ed, is that videoconferenc<strong>in</strong>g makes it more difficult for an attorney to consult with<br />
<strong>the</strong> client before <strong>the</strong> hear<strong>in</strong>g.<br />
The second common compla<strong>in</strong>t is that videoconferenc<strong>in</strong>g makes any private<br />
consultation dur<strong>in</strong>g <strong>the</strong> hear<strong>in</strong>g impossible. Only one attorney reported be<strong>in</strong>g able to<br />
speak to <strong>the</strong> immigrant by seek<strong>in</strong>g time to consult and ask<strong>in</strong>g <strong>the</strong> judge to clear <strong>the</strong> court.<br />
The vast majority <strong>of</strong> lawyers believed that private conference was impossible. Observers<br />
