<strong>Situation</strong> <strong>analySiS</strong> of Children in uganda 2015AFRICAN CHARTER ON THE RIGHTS AND WELFARE OF THE CHILD(ACRWC)Every child, regardless of his or her race, ethnic group, colour, sex, language, religion, politicalor other opinion, national and social origin, fortune, birth or other status, has the rightto: live; be named and registered at birth; adequate health care, nutritious food and safedrinking water; education and play. Children should be protected from all forms of economicexploitation and hazardous work and from all forms of torture, inhuman or degrading treatment,including sexual abuse. No child who is imprisoned should be tortured or otherwisemistreated. Those who are capable of communicating their views should be allowed toexpress their opinions freely.UGANDA CONSTITUTIONThe State shall endeavour to fulfill the fundamental rights of all Ugandans to social justiceand economic development and shall, in particular, ensure that: …all Ugandans enjoy rightsand opportunities and access to education, health services, clean and safe water, work,decent shelter, adequate clothing, food security and pension and retirement benefits.Article 34 provides specifically for the following rights of children: (1) The right to knowand be cared for by their parents or other people. (2) The right to basic education whichmust be provided by the Government and the parents of the child. (3) The right not to bedenied medical treatment or any other social or economic benefits. (4) Protection from allexploitation (being taken advantage of). (5) Children who are below the age of 16 yearsmust not be employed or do work that is harmful to their health or that interferes with theireducation. (6.) A child offender shall not be detained with adults. (7) Orphans and othervulnerable children must be specially protected by the laws of Uganda.THE CHILDREN ACTEvery child has the right to education and guidance, immunisation, an adequate diet, shelter,medical attention, and to protection from violence, abuse and neglect – including social orcustomary practices that are harmful to their health – and not to be employed or engaged inany activity that may be harmful to his or her health, education or development.Any member of the community who has evidence that a child’s rights are being infringedor that a parent, a guardian or any person having custody of a child is able to but refuses orneglects to provide the child with adequate food, shelter, clothing, medical care or educationshall report the matter to the local government council of the area.aPPENDIx 1109
