<strong>Situation</strong> <strong>analySiS</strong> of Children in uganda 2015AFRICAN CHARTER ON THE RIGHTS AND WELFARE OF THE CHILD(ACRWC)The ACRWC was adopted by the Organisation of African Unity (OAU) in 1990 to localise theprovisions of the UNCRC in Africa. As in the UNCRC, the Charter recognises child participationas a means to ensuring that all actions and decisions by individuals or authorities aretaken in the best interests of the child. The main articles that provide for the participationof children are 4 and 7.CHILDREN ACT, CAP 59The Children Act (Cap 59) has provisions to uphold the right to participation on issues thataffect children’s survival and development. The act aims to ensure that the child participatesand provides evidence in situations where a matter is reported to the probation office. Asecretary for children’s affairs in each local council is responsible for ensuring that children’svoices are heard.LOCAL GOVERNMENTS ACT, CAP 243Section 8 of the third schedule (1) (a) of the Local Governments Act states that ‘A Councilorshall maintain close contact with the electoral area, and consult the people on issues tobe discussed in the council where necessary’. Sub-section (1) (b) goes on to provide forsharing views from the electorate with the council by requiring the councillor to presentviews, opinions and proposals to the council. Sub-section (d) provides for councillors tomeet with the electorate on a regular basis; and (e) requires one to report to the electoratethe general decisions of the council and the actions it has taken to solve problems raised bythe residents in the electoral area. Councils are obliged to consult with their constituencies,including children, and to provide feedback on what occurs in their sessions.116 aPPENDIx 1
