11 THE COURT: As to 1<strong>25</strong>, the report, what I understand,<br />
12 if I'm correct, this came from a military officer to the<br />
13 Embassy, the Ambassador.<br />
14 MR. Van AELSTYN: No, your Honor. It was a document<br />
15 prepared by a Salvadoran military officer reporting on the<br />
16 action taken on May 7, 1980, by elements of the Salvadoran<br />
17 military, which Roberto D'Aubuisson, Alvaro Saravia and others<br />
18 were arrested.<br />
19 THE COURT: But did not this not somehow become<br />
20 transmitted to the Ambassador's office?<br />
21 MR. Van AELSTYN: Yes, your Honor, it did.<br />
22 THE COURT: I don't know whether it was from Colonel<br />
23 Majano or had came from some other officer.<br />
24 MR. Van AELSTYN: I had understood Ambassador White<br />
<strong>25</strong> to testify it came from Colonel Majano.<br />

1 THE COURT: All right. Then it is a report not<br />
2 prepared by the -- it is not a public report or record of the<br />
3 United States. But it is a document that was received by the<br />
4 Embassy in the capacity of its official conduct of its<br />
5 statutory mission in El Salvador, and I will let you<br />
6 provide -- it occurs that, in terms of reliability and<br />
7 authenticity, there could or could not be motives for an<br />
8 accurate report of the arrest to be made.<br />
9 The fact of the arrests is probably a matter that<br />
10 would be, if the information were provided, judicially<br />
11 noticeable, if it was sufficiently publicized within the<br />
