2 MR. Van AELSTYN: Yes, your Honor, we are, and my<br />
3 colleague, Matthew Eisenbrandt will be examining the next<br />
4 witness.<br />
5 MR. EISENBRANDT: Your Honor, does it make sense to<br />
6 take the morning break at this time before we begin with that<br />
7 witness?<br />
8 THE COURT: We can do that. I did want to tell the<br />
9 parties that due to a prior commitment established long before<br />
10 this hearing was set, I have to speak at the noon hour, and so<br />
11 we are going to have to recess at about 11:45 today and we<br />
12 will get back as close to 1:30 as is humanly possible. I have<br />
13 got to go out to north Fresno to speak. But I'm sorry, it was<br />
14 scheduled long in advance, months ago, before this hearing.<br />
15 And so if you want to take the morning recess now, we<br />
16 can. We will stand in recess until 10:45.<br />
17 MR. EISENBRANDT: If I may, our translator apparently<br />
18 is only available through this morning and is not available<br />
19 this afternoon. She also has another commitment this<br />
20 afternoon.<br />
21 THE COURT: All right. Then let's start the<br />
22 testimony now. We will take a shorter break and see if we can<br />
23 get through it.<br />
