Who may apply <strong>for</strong> PVP?<br />
Anyone who is <strong>the</strong> owner, breeder, developer, or discoverer <strong>of</strong> a unique cultivar <strong>of</strong> a<br />
sexually reproduced or tuber-propagated plant may apply <strong>for</strong> Plant Variety <strong>Protection</strong>. This<br />
applies to citizens <strong>of</strong> <strong>the</strong> United States, as well as citizens <strong>of</strong> countries that are members <strong>of</strong><br />
<strong>the</strong> <strong>International</strong> <strong>Union</strong> <strong>for</strong> <strong>the</strong> <strong>Protection</strong> <strong>of</strong> <strong>New</strong> Varieties <strong>of</strong> Plants (<strong>UPOV</strong>). The<br />
applicant may be an individual, a public institution, or a corporation.<br />
What if I have already sold seed <strong>of</strong> my variety but would still like to have it protected?<br />
As long as you have not sold seed <strong>of</strong> <strong>the</strong> variety, <strong>of</strong>fered it <strong>for</strong> sale, or advertised it <strong>for</strong> sale<br />
<strong>for</strong> more than 1 year be<strong>for</strong>e <strong>the</strong> date your application is filed in <strong>the</strong> US Plant Variety<br />
<strong>Protection</strong> Office, your variety is still eligible <strong>for</strong> protection.<br />
How is protection obtained?<br />
Application <strong>for</strong> protection <strong>of</strong> a plant variety is made in writing to:<br />

This <strong>of</strong>fice will provide <strong>for</strong>ms and instruction on how to file applications.<br />
Material required to apply <strong>for</strong> protection includes: <strong>the</strong> written part <strong>of</strong> <strong>the</strong> APPLICATION<br />
containing:<br />
1. <strong>the</strong> name or temporary designation <strong>of</strong> <strong>the</strong> new variety<br />
2. <strong>the</strong> pedigree, breeding methods, and selection criteria used in developing <strong>the</strong> variety<br />
3. pro<strong>of</strong> that <strong>the</strong> variety is distinct, uni<strong>for</strong>m , and stable.<br />
4. a botanical description <strong>of</strong> <strong>the</strong> variety, using <strong>the</strong> standard <strong>for</strong>mat provided by <strong>the</strong> Plant<br />
Variety <strong>Protection</strong> Office <strong>for</strong> <strong>the</strong> crop species<br />
5. a statement <strong>of</strong> <strong>the</strong> basis <strong>of</strong> ownership and explanation <strong>of</strong> who, including <strong>the</strong> breeder,<br />
has rights to <strong>the</strong> variety<br />
6. <strong>for</strong> sexually reproduced crops, a sample <strong>of</strong> at least 3,000 <strong>of</strong> <strong>the</strong> untreated viable basic<br />
seed required to reproduce <strong>the</strong> variety, or with <strong>the</strong> application <strong>for</strong> a tuber-propagated<br />
variety, verification that a viable cell culture has been deposited in a public depository<br />
and will be maintained <strong>for</strong> <strong>the</strong> duration <strong>of</strong> <strong>the</strong> certificate<br />
7. filing and examination fees totaling $4,381 payable when <strong>the</strong> application is submitted.
