Pursuant to what is set forth in article 22 of the Bidding<br />
Terms and Conditions, prior to beginning the construction<br />
of the works, the Company has had to develop the Detailed<br />
Engineering for the Project and present it to the State<br />
Inspector for approval including all of the works subject<br />
matter of the concession defined in the Bidding Terms and<br />
Conditions and the Company’s Technical Bid, and the works<br />
which have not been projected but are required by the<br />
Bidding Terms and Conditions, which must comply with the<br />
terms and conditions stipulated in the Concession Contract<br />
documents.<br />
With regard to the Detailed Engineering of the tunnels,<br />
the Company has had to comply with the minimum<br />
requirements stipulated in article 2.2.3 of the Bidding Terms<br />
and Conditions.<br />
The Detail Engineering Projects to be prepared by the<br />
Concession-holding Company have been adapted to the<br />
conditions set forth in the Technical Terms and Conditions<br />
that form part of the Bidding Terms and Conditions, and<br />
to the minimum standards established in the Preliminary<br />
projects and Reference Studies that are part of its Technical<br />
Offer, as well as to the standing regulations, and particularly<br />
to the Instructions given by the Departments of Surveys, of<br />
Bridges, Tunnels and Signaling and of Road Safety or the<br />
Departments of the Roads Bureau acting in their lieu, having<br />
to take into consideration, among other documents, those<br />
individualized in article 2.2.1 of the Bidding Terms and<br />
Conditions.<br />
4. The Concession-holding Company has implemented an<br />
Electric Toll Collection System for the right of passage, the<br />
characteristics of which must correspond to those stipulated<br />
in article 2.2.4 of the Bidding Terms and Conditions and the<br />
general, necessary and specific requirements of which must<br />
be fully complied with, are respectively described in articles<br />
1.15.1, 1.15.2, 1.15.3 of the Bidding Terms and Conditions.<br />
According to the Financial Bid of the Successful Bidding<br />
Group, the maximum value of the Base Rate in Off-peak<br />
Hours (TBFP) in the direction of Kennedy-El Sato is set at<br />
Ch$125 denominated to pesos at December 31, 2003, for<br />
vehicles classified as Type 1, according to table 7 of the<br />
Bidding Terms and Conditions.<br />
According to article 1.14 of the Bidding Terms and<br />
Conditions, the Company awarded with the concession<br />
must comply with the following provisions to set its tariffs.<br />
Charging tariffs that exceed the maximum authorized, and/<br />
or the failure to comply the terms and conditions set forth<br />
for their collection, will cause the Company to be subject to<br />
the fine set forth in article 1.8.10 of the Bidding Conditions,<br />
notwithstanding the cashing of the performance bonds set<br />
forth in article 1.8.1 of the Bidding Terms and Conditions,<br />
and the appropriate legal actions.<br />
