As a result of the new works, the total and partial periods<br />
of the concession contract were amended, with the new<br />
deadlines being the following:<br />
1. Deadline for submitting the third Progress Report: August<br />
20,2007.<br />
2. Deadline for presenting the fourth Progress Report:<br />
January 20,2008.<br />
3. Deadline for obtaining the Provisional Placement into<br />
Service for the entire works: June 20, 2008.<br />
4. The term of the concession will be for 390 months as of<br />
its start as set forth in article 1.7.5 of the Bidding Terms and<br />
Conditions, and consequently it will expire on August 20,<br />
2037.<br />
The concepts under which this contract is organized and<br />
their final values are the following the following:<br />
1. New works and services to perform: UF 777,177.23<br />
2. Works that will not be Executed: UF(165,002.17)<br />
3. Total net value: UF 612,175.06<br />
In addition to the items shown, it is important to highlight<br />
that the additional Changes in Services needed to carry out<br />
the works of the so-called “Alternativa Pirámide”, in excess<br />
of the amount included for this item in number 1 of the<br />
previous paragraph, will be regulated according to article<br />
1.8.19 of the Bidding Terms and Conditions.<br />
The MOP paid the Concession-holding Company UF<br />
635,000 in December, 2007. At the cut-off date of the<br />
accounting control accounts for the cost of the works,<br />
there was a balance in favor of the MOP in the amount of<br />
UF 9,218.84, which was paid by the Concession-holding<br />
Company on August 29,2008.<br />
The works contracted by virtue of this agreement did not<br />
involve any additional payments by the Concession-holding<br />
Company to the MOP, for supervision, administration or<br />
control of the Concession-holding Company.<br />
The performance bonds referred to in articles 1.8.1.1 and<br />
1.8.1.2 of the Bidding Terms and Conditions will be fully<br />
applicable to the obligations of the Concession-holding<br />
Company under this Supplementary Agreement.<br />
The agreement contemplates that the MOP may demand<br />
from the Concession-holding Company, for reasons of<br />
public interest and urgency as set forth in article 69 No.<br />
4 of the Regulations, to modify the contracted works and<br />
services, with a view to improving and/or building incoming<br />
and outgoing tunnel connections in the southern area of the<br />
project, specifically the widening of Avenida El Cerro with<br />
a bridge over the Mapocho River that connects opposite<br />
Nueva Tajamar street, as well as structures and road works<br />
for the connection to the Lo Saldes bridge and Costanera<br />
Norte, or equivalent works.<br />
b) Modifications to the concession contract by way of MOP<br />
Supreme Decree No. 514<br />
The concession contract for the public works known as<br />
“Variante Vespucio-El Salto-Kennedy” was amended by<br />
Supreme Decree 514 of the Ministry of Public Works of July<br />
29,2008, published on the Official Gazette of November<br />
14, 2008. This amendment set forth an operating plan for<br />
the work consisting of four stages, the main aspects of which<br />
are described below:<br />
Stage 1: It considered two Operating Phases starting from<br />
the date on which provisional Placement into Service of the<br />
entire works was authorized (July 4,2008):<br />
Phase 1.A: This phase contemplated opening the tunnel for<br />
South-North traffic, with two lanes and restricted hours from<br />
7:30 a.m. to 10:00 a.m and 5:00 p.m. to 9:00 p.m.<br />
Scheduled start date: Starting from the date on which<br />
provisional Placement into Service of the entire work was<br />
authorized (July 4, 2008).<br />
Scheduled end date: One week after the start.<br />
Phase 1.B: This phase considered opening the tunnel for<br />
South-North traffic, with two lanes and no time restrictions.<br />
