6. Human rights and equality<br />

6.1 What is the Human Rights Act?<br />

The Human Rights Act 1998 brought into domestic UK law many of the rights protected by<br />

the European Convention on Human Rights. The Human Rights Act 1998 applies to all<br />

individuals in the UK regardless of whether or not they are UK nationals.<br />

If you feel your rights under the Act have been violated, you can seek a remedy through the<br />

UK courts.<br />

6.2 What rights do I have under the Act?<br />

Under the Human Rights Act 1998, while in the UK you have the following rights.<br />

Everyone’s right to life is protected by law.<br />

No one can be subjected to torture or to inhuman or degrading treatment or<br />

punishment.<br />

No one can be held in slavery or servitude or be required to perform forced or<br />

compulsory labour.<br />

Everyone has the right to liberty and security of person.<br />

Everyone is entitled to a fair and public hearing within a reasonable time by an<br />

independent and impartial tribunal established by law.<br />

No one can be subject to retroactive penalties or law (meaning that you cannot be<br />

punished for actions that were committed before a law existed that covered these<br />

actions).<br />

Everyone has the right to respect for his/her private and family life, home and<br />

correspondence.<br />

Everyone has the right to freedom of thought, conscience and religion.<br />

Everyone has the right to freedom of expression.<br />

Everyone has the right to freedom of peaceful assembly and to freedom of association<br />

with others, including the right to form and to join trade unions for the protection of<br />

their interests.<br />

Men and women of marriageable age have the right to marry and to found a family,<br />

according to the national laws governing the exercise of this right.<br />

Everybody is entitled to the peaceful enjoyment of his or her possessions.<br />

No one can be denied the right to education.<br />

There must be free elections at reasonable intervals by secret ballot, under conditions<br />

which ensure the free expression of the opinion of the people in the choice of the<br />

legislature.<br />

The enjoyment of the rights and freedoms set out above must be secured without<br />

discrimination on any ground such as sex, race, colour, language, religion, political or other<br />

opinion, national or social origin, association with a national minority, property, birth or<br />

other status.<br />
