CURRENT LEGISLATION<br />

MME as the competent ministry, in<br />

accordance with the Law on Mining (“Official<br />

Gazette” Nos. 44/95 and 34/08),<br />

issued the approvals for sampling the<br />

technological sample on the approved<br />

prospecting area. In accordance with the<br />

Article 28, Paragraph 4, which says that<br />

the “Simplified Mining Project is developed<br />

for mining works on prospecting the<br />

mineral resources”, MME on request of<br />

interested persons in accordance with the<br />

Law on Geological Investigations (“Official<br />

Gazette” No. 44/95) have the approval<br />

for geological prospecting, issue the decisions<br />

to the enterprise or company for<br />

giving the consent for sampling to the aim<br />

of testing the quality of mineral raw materials.<br />

Reali<strong>za</strong>tion of mining works, in accordance<br />

with the Article 37 of the Law on<br />

Mining (“Official Gazette” Nos. 44/95<br />

and 34/08), can be accessed, as referred to<br />

in the Paragraph 1 “upon obtained the<br />

approval of Ministry, and if these works<br />

affect the water regime and environment<br />

and the Ministry in charge for water management,<br />

and environment protection”.<br />

SAMPLING WITHIN THE GEO-<br />

LOGICAL PROSPECTING WORKS<br />

Technological investigations are aimed<br />

to the data obtaining on recovery degree<br />

of raw materials into final products. In<br />

addition, the workability, cleavage, milling,<br />

grinding, polishing, etc., are also determined.<br />

By analyzing this way of sampling on<br />

the prospecting fields, it is seen that since<br />

2003 until 2009, the interest in sampling of<br />

mineral raw material from the prospecting<br />
