State Historic Cultural Resource Laws, Statutes, <strong>and</strong> Regulations<br />
In addition to the Federal regulatory framework <strong>gov</strong>erning management of cultural resources,<br />
state laws (<strong>and</strong> the regulations <strong>and</strong> agreements emanating from them) <strong>gov</strong>ern the treatment of<br />
historic <strong>and</strong> archaeological resources in North Dakota. Such laws are generally restricted to<br />
protection of cultural resources that may be threatened by Federal, state-funded, or state statepermitted<br />
projects. North Dakota's cultural resources regulatory framework that may be relevant<br />
to <strong>CBP</strong>’s mission <strong>and</strong> programs are:<br />

North Dakota Century Code 55-03-01 requires permits to investigate, evaluate, or<br />
mitigate adverse effect on cultural resources, historic buildings, structures, or objects<br />
under Section 106. It also requires permits to conduct investigations on state l<strong>and</strong>.<br />
North Dakota Century Code 55-10-11 created the SHPO.<br />
North Dakota Century Code 23-06-27 protects unmarked human burials <strong>and</strong> establishes<br />
treatment procedures.<br />
North Dakota Century Code 55-02-07 protects prehistoric <strong>and</strong> historic sites on state l<strong>and</strong><br />
<strong>and</strong> restricts access to location data.<br />
North Dakota Century Code 55-02-09 establishes an emergency impact mitigation fund.<br />
State Historic Preservation Office<br />
The North Dakota State Historic Preservation Office (SHPO) is a division of the State <strong>Historical</strong><br />
Society of North Dakota (SHSND). The duties of the North Dakota SHPO are to:<br />

Locate, survey, investigate, register, identify, preserve, <strong>and</strong> protect historic, architectural,<br />
archaeological <strong>and</strong> cultural sites, structures, <strong>and</strong> objects worthy of preservation;<br />
Evaluate historic properties for significance <strong>and</strong> nominate them to the National Register<br />
of Historic Places;<br />
Review all Federal undertakings permitted, funded, licensed or otherwise assisted;<br />
Administer Federal tax incentives for the preservation of historic buildings;<br />
Assist Federal <strong>and</strong> state agencies in their responsibility to identify <strong>and</strong> protect historic<br />
properties <strong>and</strong> archaeological sites that may be affected by their projects; <strong>and</strong><br />
Provide preservation education, training, <strong>and</strong> technical assistance to individuals <strong>and</strong><br />
groups as well as local, state, <strong>and</strong> Federal agencies <strong>and</strong> tribes.<br />
