C OMPETITION P RINCIPLES A GREEMENT<br />

Competition Principles Agreement<br />

The Competition Principles Agreement (CPA) is a contractual agreement between the federal government and all state and territory<br />

governments. Local government is committed to the CPA through the state governments’ involvement. The focus <strong>of</strong> the CPA is to ensure that<br />

all public enterprises operate in a transparent manner in the best public interest. This requires that public enterprises review their operations<br />

to ensure that they do not have a competitive advantage or disadvantage resulting from their status as public enterprises.<br />

To ensure compliance with the CPA, local governments are required to include in their annual reports certain particulars in relation to CPA.<br />

The Town <strong>of</strong> <strong>Vincent</strong> supports the concept <strong>of</strong> the CPA and in this regard the following particulars are reported.<br />

Competitive Neutrality<br />

This principle deals with ensuring that government business operations do not have any advantage or disadvantage in comparison with the<br />

private sector. At present no activities undertaken by the Town have been classified as either a Public Trading Enterprise (PTE) or a Public<br />

Financial Enterprise (PFE) by the Australian Bureau <strong>of</strong> Statistics.<br />

During the reporting period the Town has not received any allegations <strong>of</strong> non-compliance with the principles <strong>of</strong> Competitive Neutrality.<br />

Structural Reform <strong>of</strong> Public Monopolies<br />

The Town does not operate any Public Monopolies within the CPA definition and accordingly there is no reporting requirement. The Town did<br />

not privatise any activities during <strong>2004</strong>-<strong>2005</strong>.<br />

Legislation Review<br />

Within the principles <strong>of</strong> the CPA is a requirement for local governments to review all existing legislation to ensure that the legislation does<br />

not restrict competition, or if restrictive legislation is in place, it is in the best interests <strong>of</strong> the community.<br />

Local Laws<br />

During the year the Town continued the process <strong>of</strong> reviewing all Local Laws. The Local Government Act 1995 requires all existing Local<br />

Laws to be reviewed every eight years. As part <strong>of</strong> this process the intention to review Local Laws is advertised in the press as required by<br />

the Local Government Act, thus giving residents and ratepayers the opportunity to comment on any proposed changes, additions or deletions<br />

to the Town’s Local Laws.<br />
