We have assumed that all three parties fielded 3 candidates in each constituency in <strong>the</strong> Island <strong>of</strong> <strong>Mauritius</strong> and 2 in <strong>the</strong> Island <strong>of</strong> Rodrigues. All <strong>the</strong>se defeated candidates who are found on this list are now divided in <strong>the</strong> 4 Categories, A, B, C and D. They are now ranked in each Category according to <strong>the</strong> percentage <strong>of</strong> votes <strong>the</strong>y received at <strong>the</strong> elections. Only <strong>the</strong> communal Category is taken into account to select <strong>the</strong> first batch <strong>of</strong> 4 <strong>best</strong> <strong>loser</strong>s. When it has been decided from which <strong>of</strong> <strong>the</strong> four categories <strong>the</strong> <strong>best</strong>-<strong>loser</strong>s will be taken, <strong>the</strong> defeated candidate with <strong>the</strong> highest percentage <strong>of</strong> votes from that category is appointed. The result is as follows: Category A 0 Category B 2 Category C 2 Category D 0 Once <strong>the</strong> first four <strong>best</strong> <strong>loser</strong>s have been identified, let us assume that it is <strong>the</strong>n observed by <strong>the</strong> Electoral Commission that <strong>the</strong>y come from <strong>the</strong> following party: PARTY V 2 PARTY W 2 PARTY Y 0 For <strong>the</strong> selection <strong>of</strong> <strong>the</strong> second batch <strong>of</strong> <strong>best</strong>-<strong>loser</strong>, <strong>the</strong> communal category and <strong>the</strong> political party <strong>of</strong> origin are taken into account. Section 5( 4 ) <strong>of</strong> <strong>the</strong> First schedule provides as follows : “When <strong>the</strong> first 4 seats (or as many as possible <strong>of</strong> those seats) have been allocated, <strong>the</strong> number <strong>of</strong> such seats that have been allocated to persons who belong to parties, o<strong>the</strong>r than <strong>the</strong> most successful party, shall be ascertained and so far as possible that number <strong>of</strong> seats out <strong>of</strong> <strong>the</strong> second 4 seats shall one by one be allocated to <strong>the</strong> most successful unreturned candidates, if any, belonging both to <strong>the</strong> most successful party and <strong>the</strong> appropriate community, or where <strong>the</strong>re is no unreturned candidate <strong>of</strong> <strong>the</strong> appropriate community, to <strong>the</strong> most successful unreturned candidates belonging to <strong>the</strong> most successful party, irrespective <strong>of</strong> community.” Since Party W has obtained 2 <strong>best</strong>-<strong>loser</strong>s in <strong>the</strong> first batch, Party V will obtain <strong>the</strong> Fifth and <strong>the</strong> Sixth <strong>best</strong>-<strong>loser</strong>s as it is <strong>the</strong> “most successful party”. The appointment <strong>of</strong> <strong>the</strong> 7th. <strong>best</strong> <strong>loser</strong> will be governed by Section 5 (5) <strong>of</strong> <strong>the</strong> First Schedule which provides as follows:
