So, <strong>the</strong>re is a philosophical flaw in taking too much note <strong>of</strong> <strong>Lalit</strong>’s letter in which we said we<br />

will not be “Best Losers”. If we are elected, <strong>the</strong> problem remains as large as ever. This is<br />

because <strong>the</strong> whole <strong>of</strong> <strong>the</strong> National Assembly is infected by <strong>the</strong> communal classification <strong>system</strong>.<br />

We were aware <strong>of</strong> this philosophical deficiency when we sent in our letter. We submitted <strong>the</strong><br />

letter anyway, in order to show that we were not writing down a community just in order to gain<br />

some personal advantage from our re-classification, but as a pro<strong>of</strong> <strong>of</strong> our honesty. We believe<br />

that <strong>the</strong>re is no such thing as “community” except as a set <strong>of</strong> shared prejudices existing at a<br />

particular time and place. We do not share those prejudices, and are <strong>the</strong>refore UNABLE to<br />

classify ourselves as being ei<strong>the</strong>r IN or NOT IN any <strong>of</strong> <strong>the</strong> so-called “communities”.<br />

In addition, <strong>the</strong>re is a logical problem within <strong>the</strong> Judgement: Once classified “properly” by <strong>the</strong><br />

Supreme Court under <strong>the</strong> Constitution, we should, legally speaking, become “real<br />

representatives” <strong>of</strong> our supposedly objectively correct community, and we should expect to be<br />

encouraged by <strong>the</strong> law to take up “<strong>best</strong> <strong>loser</strong> seats”. (For political and moral reasons, we would<br />

<strong>of</strong> course, in turn, refuse.) But instead <strong>the</strong> judgment wants us to be bound NOT to take <strong>best</strong> <strong>loser</strong><br />

seats (so as not to count our “community), while yet still being entitled to take up elected seats<br />

(where our “community” will be totted up in <strong>the</strong> <strong>best</strong> <strong>loser</strong> <strong>system</strong> for eight o<strong>the</strong>rs).<br />

Strong words: “member <strong>of</strong> a party”, “member <strong>of</strong> a community” on<br />

Nomination Papers<br />

Ano<strong>the</strong>r point needs emphasis.<br />

Becoming a “member” <strong>of</strong> something is a very specific act. One applies and is accepted by<br />

o<strong>the</strong>rs into a usually fairly closed group.<br />

In order to oblige someone to decide if he or she is or is not a member <strong>of</strong>, say, something as<br />

vague as “<strong>the</strong> H… community” and to do this “by his or her way <strong>of</strong> life” is indeed a tall order.<br />

By contrast, when <strong>the</strong> identical question is asked <strong>of</strong> candidates on <strong>the</strong> Nomination Paper for<br />

General Elections about <strong>the</strong>ir membership <strong>of</strong> a political party, this is very easy to answer. I say I<br />

am a member <strong>of</strong> <strong>the</strong> <strong>Lalit</strong> Party. I know I am, because I applied for membership, I pay my dues<br />

and I attend meetings. In addition, I am required to produce a letter from <strong>the</strong> leaders <strong>of</strong> this party<br />

in which <strong>the</strong>y certify that <strong>the</strong>y know that I am a member and that I am to stand for election in<br />

such and such a Constituency for <strong>the</strong> party. This also is very easy for <strong>the</strong>m to do because <strong>the</strong>y<br />

know it. Members <strong>of</strong> <strong>Lalit</strong> and non-members <strong>of</strong> <strong>Lalit</strong> are two clear categories in <strong>the</strong> world.<br />

But what does one do as regards <strong>the</strong> declaration on <strong>the</strong> Nomination Paper as to membership <strong>of</strong> a<br />

“community”? I never applied for membership <strong>of</strong> any community, and I know no-one else in <strong>the</strong><br />

country who ever did ei<strong>the</strong>r. There are no dues and no meetings. The fact that I do not know if I<br />

am a member <strong>of</strong>, say, “<strong>the</strong> H…. community” or am not a member is a problem for me. Once I<br />

am in this difficulty, according to <strong>the</strong> Supreme Court Judgment in <strong>the</strong> recent case, I would<br />

probably need to check with myself if I am a member <strong>of</strong> “<strong>the</strong> M…. community” or “<strong>the</strong> S-M…<br />

community” and if I do not know that I am a member <strong>of</strong> <strong>the</strong>se three, <strong>the</strong>n I am automatically to<br />

assume that I am a member <strong>of</strong> “<strong>the</strong> G…. P….. community”. But it is not as simple as that. My<br />

difficulty is compounded by <strong>the</strong> fact that I don’t know for sure <strong>of</strong> anyone else in <strong>the</strong> country<br />

who is a member <strong>of</strong> <strong>the</strong> first three communities, while at <strong>the</strong> same time I also know, from <strong>the</strong><br />

1972 Census, that some three-quarters <strong>of</strong> <strong>the</strong> people were <strong>the</strong>n classified by <strong>the</strong> state as being in<br />

<strong>the</strong>se first three communities, and <strong>the</strong>se exact figures are now kept to by <strong>the</strong> Constitution itself,<br />

and used by <strong>the</strong> Electoral Supervisory Commission in <strong>the</strong> increasingly complicated task <strong>of</strong><br />

allocating <strong>best</strong> <strong>loser</strong> seats. Since I don’t know who are <strong>the</strong> people who are members <strong>of</strong> <strong>the</strong> H…<br />

Community, for example, how can I know that I am or I am not one. The only guidelines I am<br />

given are that I must compare my “way <strong>of</strong> life” with <strong>the</strong> “way <strong>of</strong> life” <strong>of</strong> o<strong>the</strong>r people, who I<br />

know are or are not in <strong>the</strong> community, and <strong>the</strong>n classify myself. And this is just not helpful to<br />

me in deciding, because I cannot classify o<strong>the</strong>r people ei<strong>the</strong>r, nei<strong>the</strong>r by <strong>the</strong>ir way <strong>of</strong> life, nor<br />

any o<strong>the</strong>r way, into <strong>the</strong>se so-called “communities”. O<strong>the</strong>r peoples’ way <strong>of</strong> life is remarkably<br />

similar to mine: I do similar work to many people, I catch <strong>the</strong> same buses, I speak <strong>the</strong> same<br />

language as everyone else in <strong>the</strong> hospital and at <strong>the</strong> post <strong>of</strong>fice, I chat to <strong>the</strong> neighbours about<br />

this and that just like everyone else does, I visit friends and relatives like o<strong>the</strong>r people do, I wash<br />

my clo<strong>the</strong>s and clean my floors like everyone else, I go and buy things in <strong>the</strong> shop or <strong>the</strong><br />

supermarket just like most o<strong>the</strong>r people, <strong>the</strong> house I live in is a lot like most o<strong>the</strong>r peoples’<br />

houses.<br />

Curiously, <strong>the</strong> only people in <strong>Mauritius</strong> who have ever been individually classified in public<br />

(since Independence at least, and <strong>the</strong>y are in fact auto-classified) are those individuals who<br />

stood as candidates for General Elections. Each candidate placed a “community” on <strong>the</strong>ir
