Letter were: ClearChoice Energy ("ClearChoice"); C<strong>Power</strong>, Inc. ("C<strong>Power</strong>");<br />

The E Cubed Company, LLC ("E Cubed"); Energy Association of <strong>Penn</strong>sylvania<br />

("EAP"); Metropolitan Edison Company ("Met-Ed'), <strong>Penn</strong>sylvania Electric Company<br />

("Penelec"), and <strong>Penn</strong>sylvania <strong>Power</strong> Company ("<strong>Penn</strong> <strong>Power</strong>"), (collectively,<br />

"FirstEnergy"); the National Association of Energy Service Companies ("NAESCO");<br />

PECO Energy Company ("PECO"); <strong>Penn</strong>sylvania Utility Law Project ("PULP");<br />

Positive Energy, Inc. ("Positive Energy"); PPL Electric Utilities <strong>Corporation</strong> ("PPL");<br />

Reliant Energy, Inc., ("Reliant"); and <strong>West</strong> <strong>Penn</strong> <strong>Power</strong> Company, d/b/a Allegheny<br />

<strong>Power</strong> ("Allegheny").<br />

On December 22, 2008, the Commission entered a Tentative Order tentatively<br />

establishing the Conservation Service Provider Registry. The Tentative Order w<strong>as</strong> to<br />

become final unless adverse comments were received no later than January 2, 2009.<br />

Allegheny, EAP, FirstEnergy, PECO, Positive Energy and PPL ali filed adverse<br />

comments. These comments will be addressed in the applicable sections below.<br />

DISCUSSION<br />

With this implementation order the Commission establishes a registry of<br />

conservation service providers <strong>as</strong> directed by Act 129 of 2008. 66 Pa.C.S. § 2806.2. This<br />

conservation service provider ("<strong>CSP</strong>") registry will be administered and maintained by<br />

the Bureau of Fixed Utility Services ("FUS"). The Commission stresses that the<br />

qualifications established herein are minimum qualifications for registration and that<br />

EDCs will be permitted to establish additional re<strong>as</strong>onable requirements b<strong>as</strong>ed on the type<br />

and scope of work to be performed by the <strong>CSP</strong>.<br />
