e. Any Employee who refuses to take a substance abuse test shall be removed from the job<br />
site immediately.<br />
f. It is the Seller's responsibility to notify any Employee removed from the job site, for any of<br />
the re<strong>as</strong>ons listed above, that they are prohibited from employment on Buyer's property<br />
for a period of one year. In addition, it is the Seller's responsibility to notify the<br />
Employee's union representative of any disciplinary action taken due to substance abuse.<br />
6.0 ADMINISTRATION<br />
a. Responsible Buyer Empioyee and Responsible Seller Employee are those individuals<br />
who shall be designated to receive, in a confidential manner, all information relative to<br />
positive test results.<br />
b. Seller will submit their substance abuse testing program <strong>with</strong> their Proposal. Buyer will<br />
review the program and, if acceptable, it will become part of the Purch<strong>as</strong>e Order. If<br />
unacceptable or the Seller h<strong>as</strong> no program, this Program shall become part of the<br />
Purch<strong>as</strong>e Order.<br />
c. Pre-employment Screening:<br />
1) Each Seller shall be responsible for verifying that all their Employees brought on<br />
site are drug-free. No personnel <strong>with</strong> positive results will be allowed to work for a<br />
Seller under Purch<strong>as</strong>e Order <strong>with</strong> Buyer. A three-day grace period is permitted<br />
to allow for turnaround of the test results.<br />
2) Each Seller shall properly notify the Buyer's Technical Representative in writing<br />
that all of the Employees brought on site are drug-free. The Seller shall maintain<br />
a file on all test results, which may be audited by Buyer.<br />
3) The Seller shall notify the Responsible Buyer Employee of any positive test<br />
results (by Social Security Number only) in a confidential manner.<br />
d. Re<strong>as</strong>onable Cause or Accident/Safety Violation:<br />
1) Any Employee may be tested for controlled substances and/or alcohol upon a<br />
showing of re<strong>as</strong>onable cause. If the Employee tests positive for drugs and/or<br />
alcohol, the Employee shall be removed from the job site immediately. The<br />
Seller is solely responsible for the administration and cost of all testing.<br />
2) Any Employee who causes or is involved in a workplace accident/safety violation,<br />
which causes property damage, injury, or death, shall be tested for controlled<br />
substances and/or alcohol. If the Employee tests positive for drugs and/or<br />
alcohol, the Employee shall be removed from Buyer's job site immediately. The<br />
Seller is solely responsible for the administration and cost of all testing.<br />
