Appendix # 9<br />
1.0 PURPOSE<br />
Allegheny <strong>Power</strong>, Substance Abuse Policy<br />
Buyer is firmly committed to providing a safe workplace and to promoting high standards of<br />
Employee health and safety. The objective is to establish and maintain a work environment that<br />
is free from the effects of alcohol and drug abuse. A work environment free from drugs and<br />
alcohol is especially important in the electric utility industry because of our b<strong>as</strong>ic responsibility to<br />
serve the public safely and <strong>with</strong>out interruption.<br />
2.0 POLICY<br />
a. Buyer h<strong>as</strong> established a system policy ; Drug and Alcohol Abuse, and a<br />
Substance Abuse Testing Program for its Employees. In a like manner, every<br />
Seller having a Purch<strong>as</strong>e Order <strong>with</strong> Buyer, whereby work will be performed for<br />
Buyer, shall be required to administer a mandatory substance abuse program. A<br />
Bidder may submit a program in lieu of this Substance Abuse Program - Retail<br />
Operations' <strong>Contract</strong>s (Program) if said program equals or exceeds all<br />
provisions and requirements of this Program. In such c<strong>as</strong>e, the program shall be<br />
submitted <strong>with</strong> the Proposal. A Bidder that does not have a program or h<strong>as</strong> a<br />
program that is not acceptable to Buyer shall abide by the criteria stipulated in this<br />
Program.<br />
b. The illegal manufacture, distribution, dispensation, possession, or use of<br />
controlled substances when working for a Seller under a Purch<strong>as</strong>e Order <strong>with</strong><br />
Buyer is prohibited and will result in disciplinary action (see Discipline).<br />
c. The unauthorized possession or use of alcohol when working for a Seller under a<br />
Purch<strong>as</strong>e Order <strong>with</strong> Buyer is prohibited and will result in disciplinary action (see<br />
Discipline).<br />
d. It shall be the sole responsibility of the Seller to have their Employees, manual<br />
and non-manual (Employees), report to work in condition to perform their duties.<br />
The off-duty use of controlled substances or alcohol, which adversely affects an<br />
Employee's job performance, is prohibited and will result in disciplinary action<br />
(see Discipline).<br />
e. The Seller shall implement a substance abuse testing program under which<br />
Employees may be required to take a substance abuse test (see Testing for Drugs<br />
or Alcohol).<br />
