management or advisory services to an EDC regarding that EDCs EE&C plan. This<br />

registry is not intended <strong>as</strong> a resource of businesses, whose sole purpose is the installation<br />

of me<strong>as</strong>ures, supplying equipment, or other contracting work for use by the general<br />

public and EDC customers.<br />

Again, the Commission reiterates that its criteria are minimum experience and<br />

qualification requirements. Thus, the Commission will allow EDCs to impose additional<br />

re<strong>as</strong>onable experience and qualification requirements that are commensurate <strong>with</strong> the<br />

type and scope of work to be performed by each <strong>CSP</strong> under the EDCs specific EE&C<br />

plan. B<strong>as</strong>ed on this interpretation ofthe Act, the Commission directs that a <strong>CSP</strong>, or its<br />

principals, must have at le<strong>as</strong>t two years of documented experience in providing program<br />

consultation, design, administration, management or advisory services related to energy<br />

efficiency and conservation services. Moreover, the Commission expects EDCs to<br />

require criminal and other background checks for any person <strong>as</strong>sociated <strong>with</strong> the EDCs<br />

EE&C plan who will enter a customer's premises or otherwise have personal contact <strong>with</strong><br />

an EDC customer. See Service Employees International Union, Local 69, AFL-CIO v.<br />

(December 19, 2003) (contractor personnel must be monitored and controlled by the<br />

Positive Energy requested that the Commission eliminate the minimum three year<br />

experience requirement for <strong>CSP</strong>s. Positive Energy <strong>as</strong>serts that this minimum requirement<br />

would exclude many well qualified <strong>CSP</strong>s. Positive Energy further <strong>as</strong>serts that Act 129<br />
