1.0 SUBCONTRACTOR PLAN POLICY A REQUIREMENTS<br />
In an efTortlo incre<strong>as</strong>e Contraci opportunities <strong>with</strong> smaP business concerns, small business concerns cwned and controlled by<br />
veterans, small business concerns owned and controlled by setvice-disabled veterans, qualilied HUB-Zone small business<br />
concerns, small business concerns owned and controlled by soaally and economically disadvantaged individuals and small<br />
business concerns owned and controlled by women, the operating companies of Allegheny Energy, Inc. in compliance wilh<br />
Public Law 95-507, Small Business investment Act. are under certain conditions, requiring contractors lo file a Subcontracting<br />
Plan.<br />
In compliance <strong>with</strong> Pifclic Law 95-507, Small Business Investment Act, 15 U.S.C. 637(d), contractors under certain conditions,<br />
are required to file a copy of their Subcontracting Plan <strong>with</strong> the operating companies of Allegheny Energy, Inc. If the<br />
contractor does nol have such a Plan, or h<strong>as</strong> a Plan, which does not meet or exceed Plan requlremente, the contractor h<strong>as</strong> the<br />
option of adopting the format ofthe Allegheny Energy. Inc. Subcontracting Plan and administering sucli a Plan (Reference<br />
Form 37-216, Allegheny Energy Setvice <strong>Corporation</strong> Subcontracting Plan),<br />
Bidder must submit a Subcontracting Plan when all ofthe following conditions apply:<br />
When a contractor is not a small business; and<br />
When a <strong>Contract</strong> exceeds $550,000; aM<br />
When a contractor will be subcontracting any portion ofthe <strong>Contract</strong>.<br />
Buyerwlll review, accept, or reject a <strong>Contract</strong>or's Subcontracflnfi Plan. At a minimum the plan must meet the requirements<br />
mandated by the Small Business Investment Act. If a successful <strong>Contract</strong>or falls to submit a Subcontracting Plan when<br />
required lo do so, or if the individual plan fails to comply <strong>with</strong> the Small Business Investment Act, Bidder will be deemed<br />
ineligible to be aivardeb the <strong>Contract</strong>,<br />
<strong>Contract</strong>or shall be solely responsible forthe implementation and administration of their Subcontracting Plan.<br />
2.0 FILING A SUBCONTRACTOR PLAN<br />
A Subcontracting Plan must be fifed <strong>with</strong> the operating companies of Allegheny Energy, Inc. either each time a Contrgcl Is b|j<br />
pron a vearlv b<strong>as</strong>ts. Each plan filed yearly will remain in effect unless updated by the contractor. The Subcontracting Plan<br />
will be kept on file for Allegheny Energy reporting purposes. Any contractor wishing to adopt the format ofthe Allegheny<br />
Energy, Inc, Subcontracting Plan and administersuch a ptogram is permittedto doso bycompleting and returning Form 37-<br />
216, Allegheny Energy Service <strong>Corporation</strong> Subcontracting Plan. All subcontracting correspondence shall be sent to:<br />

Any contractor who submits their own format of a Subconlractirg Plan must incoiporate the informalion prescribed in the Small<br />
Business Investment Act, 15 U.S.C. 637(d) 6, Review ofthe Subcontracting Plan will become part ofthe purch<strong>as</strong>ing review.<br />
Failure to submtl a Subcontracting Plan or faiure to comply wtth requirements ofthe Act will disqualify a contractor from<br />
ellglbSlty of <strong>Contract</strong> award.<br />
3.0 FILING PLAN WITH ALLEGHENY ENERGY<br />
When tiling a Subcontracting Plan <strong>with</strong> Allegheny Energy, Inc. the Plan must al a minrnmn include the following requiremente<br />
ofthe SmaP Business Investment Act, 15 U.S.C, 637(d) 6:<br />
1. Percentage goals for Ihe utilization <strong>as</strong> subcontractors of small business concerns, smal business concerns<br />
owned and controlled by veterans, smal business concerns owned and controlled by service-disabled<br />
veterans, qualified HUBZone small business concerns, small business concerns owned and controled by<br />
sodaliy and economicallv disadvantaged individuals, and small business concerns owned and controlled by<br />
women.<br />
2. Name and description ofthe duties ofthe individual responsible for admintstering the subcontracting<br />
