4.0 TESTING PROCEDURE<br />
a. The following substance abuse tests and programs are permitted for pre-employment<br />
screening:<br />
Non-DOT 10 panel<br />
NIDA 5 (DOT)<br />
Any other tests that are determined to be equivalent to these may be used upon approval<br />
of Buyer.<br />
Attachment Exhibit A-1 is a listing of approved collection sites in Buyer's territory.<br />
b. Testing for re<strong>as</strong>onable cause or work-related accidents shall be either a Non-DOT 5<br />
panel or a NIDA 5 (DOT) and will include testing for alcohol.<br />
c. Samples produced for substance abuse testing will follow the chain-of-custody procedure<br />
specified by the National Institute on Drug Abuse (NIDA) to insure the integrity and<br />
identity ofthe sample. Any screening test indicating a positive result shall be tested by a<br />
NIDA-certified laboratory and be verified by a G<strong>as</strong> Chromatography/M<strong>as</strong>s Spectrometry<br />
(GC/MS) or an equally accurate confirmation test.<br />
d. Blood samples for alcohol testing must be taken at NIDA-approved collection sites and<br />
sent to NIDA-certified laboratory under the chain-of-custody procedure specified by NIDA<br />
to <strong>as</strong>sure the integrity and identity of the samples. Blood alcohol samples in excess of<br />
.02 percent will be considered evidence of impairment for DOT covered employees<br />
where<strong>as</strong> applicable state alcohol testing levels will apply for non-DOT covered<br />
employees.<br />
5.0 DISCIPLINE<br />
Evidential Breath Testing (EBT) apparatus may be used provided it meets Federal<br />
guidelines and is operated by a certified breath alcohol technician.<br />
a. It shall be the Seller's sole responsibility to monitor their Employees' performance, to<br />
administer any disciplinary action, and to inform Employee in c<strong>as</strong>es where he/she may<br />
not, temporarily or permanently, perform work for Buyer.<br />
b. Any Employee illegally manufacturing, distributing, dispensing, possessing, or using a<br />
controlled substance while on Buyer's property shall be removed from the job site<br />
immediately and be prohibited from working for a Seller under Purch<strong>as</strong>e Order <strong>with</strong> Buyer<br />
for a period of one year.<br />
c. Any Employee having unauthorized possession or use of alcohol while on Buyer's<br />
property shall be removed immediately from the job site and be prohibited from working<br />
for a Seller under Purch<strong>as</strong>e Order <strong>with</strong> Buyer, for a period of one year, unless such<br />
Employee shows evidence of having satisfactorily completed an approved rehabilitation<br />
program.<br />
d. Any Employee having positive drug/alcohol test results shall be removed immediately<br />
from the job site and be prohibited from working for a Seller under Purch<strong>as</strong>e Order <strong>with</strong><br />
Buyer, for a period of one year, unless such Employee shows evidence of having<br />
satisfactorily completed an approved rehabilitation program.<br />
