Environmental ‘payments’ or rewards to upland communities<br />
In return <strong>for</strong> <strong>the</strong> cooperation of <strong>the</strong> upland communities <strong>in</strong> <strong>for</strong>est <strong>pro</strong>tection, <strong>the</strong> university has <strong>pro</strong>vided<br />
various <strong>for</strong>ms of rewards to <strong>the</strong> upland communities. A few years ago, it offered to accredit bona fide<br />
farmers through some <strong>for</strong>m of memorandum of understand<strong>in</strong>g between <strong>the</strong> farmer and <strong>the</strong> university.<br />
However, some of <strong>the</strong> more active vocal farmer groups want more secure tenure than this arrangement;<br />
someth<strong>in</strong>g that <strong>the</strong> university felt it was <strong>in</strong> no position to <strong>pro</strong>vide. S<strong>in</strong>ce, <strong>the</strong>re is no consensus on this<br />
aspect among <strong>the</strong> PGs, <strong>the</strong> ef<strong>for</strong>ts by <strong>the</strong> university to push this has been halted. The PGs who participated<br />
<strong>in</strong> <strong>for</strong>est boundary del<strong>in</strong>eation were given some cash <strong>in</strong>centives <strong>for</strong> <strong>the</strong> <strong>services</strong> <strong>the</strong>y rendered. Those who<br />
participate <strong>in</strong> re<strong>for</strong>estation ef<strong>for</strong>ts were also paid <strong>for</strong> <strong>the</strong>ir labour. The university has also sponsored a<br />
number of tra<strong>in</strong><strong>in</strong>g days on susta<strong>in</strong>able land uses and practices and also on livelihood development. There<br />
are also limited scholarships awarded to high-school students <strong>in</strong> <strong>the</strong> university’s ef<strong>for</strong>ts to <strong>pro</strong>vide young<br />
people better employment opportunities. Lately, <strong>the</strong> university has also given upland farmers medical<br />
discounts <strong>for</strong> <strong>the</strong> use of <strong>the</strong> university <strong>in</strong>firmary. It has also <strong>pro</strong>vided skills tra<strong>in</strong><strong>in</strong>g to those who would like<br />
to be employed <strong>in</strong> <strong>the</strong> resorts <strong>in</strong> <strong>the</strong> Los Baños-Calamba area, as a commitment made by <strong>the</strong>se resort<br />
operators as a <strong>for</strong>m of <strong>the</strong>ir <strong>in</strong>-k<strong>in</strong>d contribution or ‘payment’ <strong>for</strong> watershed-<strong>pro</strong>tection <strong>services</strong> of <strong>the</strong><br />
upland communities. Some bus<strong>in</strong>esses have also sponsored re<strong>for</strong>estation/tree-plant<strong>in</strong>g <strong>pro</strong>jects, which were<br />
contracted to <strong>the</strong> PG. There was also an NGO, which <strong>pro</strong>vided a water pump <strong>in</strong> return <strong>for</strong> <strong>the</strong> PGs ef<strong>for</strong>ts to<br />
<strong>pro</strong>tect <strong>the</strong> water sources.<br />
Currently, no payments are made to <strong>the</strong> farmers who adopt agro<strong>for</strong>estry systems and o<strong>the</strong>r susta<strong>in</strong>able<br />
practices and this situation is likely to cont<strong>in</strong>ue. There is an unwritten understand<strong>in</strong>g that upland farmers<br />
may cultivate <strong>the</strong> land <strong>in</strong> MFR, <strong>in</strong> exchange <strong>for</strong> <strong>the</strong> <strong>environmental</strong> <strong>services</strong> that <strong>the</strong>y <strong>pro</strong>vide. In a way, <strong>the</strong><br />
<strong>environmental</strong> service becomes a ‘payment’ by <strong>the</strong> farmers <strong>for</strong> <strong>the</strong>ir cont<strong>in</strong>ued use of <strong>the</strong> land resource or,<br />
vice versa, <strong>the</strong> use of <strong>the</strong> land becomes <strong>the</strong> ‘payment’ by society <strong>for</strong> <strong>the</strong> <strong>environmental</strong> service – similar to<br />
a barter transaction.<br />
Potential <strong>for</strong> ESP payments (RUPES)<br />
To address <strong>the</strong> concern regard<strong>in</strong>g <strong>in</strong>adequacy of funds required to implement <strong>the</strong> <strong>pro</strong>jects embodied <strong>in</strong> <strong>the</strong><br />
MFR master plan and at <strong>the</strong> same time, to achieve <strong>the</strong> desired attitude towards <strong>the</strong> use of <strong>the</strong> environment<br />
and natural resources <strong>in</strong> <strong>the</strong> area and <strong>in</strong> <strong>the</strong> downstream communities, <strong>the</strong> university has <strong>in</strong>itiated ef<strong>for</strong>ts to<br />
use economic <strong>in</strong>struments <strong>for</strong> MFR resources. 10 The development of economic <strong>in</strong>struments, particularly, a<br />
watershed-<strong>pro</strong>tection fee to be imposed on water users (<strong>in</strong>dustrial and household), recreational users, and<br />
o<strong>the</strong>r off-site beneficiaries of watershed <strong>pro</strong>tection was studied. Various public consultations and meet<strong>in</strong>gs<br />
with concerned agencies were held and <strong>the</strong> decision was reached that <strong>the</strong>re is a need <strong>for</strong> a multi-sectoral<br />
group to be <strong>for</strong>med to managed <strong>the</strong> fund <strong>in</strong>to which <strong>the</strong> revenues from <strong>the</strong> watershed <strong>pro</strong>tection fees would<br />
be paid.<br />
The major bottleneck to this ef<strong>for</strong>t of impos<strong>in</strong>g a watershed-<strong>pro</strong>tection fee is <strong>the</strong> legal basis <strong>for</strong> such a<br />
collection. Although <strong>the</strong> university claims that it has <strong>the</strong> legal authority to do so by virtue of <strong>the</strong> Republic<br />
Act 6967 that vests control over MFR <strong>in</strong> <strong>the</strong> university, which was supplemented by Executive Order 349<br />
that ap<strong>pro</strong>ves <strong>the</strong> MFR master plan, it is unclear whe<strong>the</strong>r <strong>the</strong>se bases will hold water <strong>in</strong> a court. It was<br />
none<strong>the</strong>less established that <strong>the</strong>re seem to be general acceptance of <strong>the</strong> pr<strong>in</strong>ciple that ‘beneficiaries of <strong>the</strong><br />
<strong>for</strong>est should contribute f<strong>in</strong>ancially to ef<strong>for</strong>ts of manag<strong>in</strong>g <strong>the</strong> resource’ among <strong>the</strong> different stakeholders.<br />
Still, <strong>the</strong> legality of such a collection by <strong>the</strong> university needs to be resolved. Alternative possibilities under<br />
discussion are collaboration with <strong>the</strong> National Water Resources Board or <strong>the</strong> Local Government Unit<br />
(LGU). Discussions on this matter po<strong>in</strong>t to <strong>the</strong> strength of <strong>the</strong> Local Government Code (see summary of<br />
major accomplishments <strong>in</strong> <strong>the</strong> Maas<strong>in</strong> Watershed <strong>in</strong> Box 2.3) as <strong>the</strong> best alternative to impose <strong>the</strong> fee. The<br />
recent experience of <strong>the</strong> Maas<strong>in</strong> watershed sets a precedent that may be adopted by o<strong>the</strong>r LGUs.<br />
The only complication is that <strong>the</strong> reliance by <strong>the</strong> university on <strong>the</strong> LGU would mean <strong>the</strong> transfer (or<br />
shar<strong>in</strong>g) of control of MFR management to <strong>the</strong> LGU. There is still a general apprehension <strong>in</strong> certa<strong>in</strong> sectors<br />
of <strong>the</strong> university that br<strong>in</strong>g<strong>in</strong>g <strong>the</strong> LGU <strong>in</strong>to <strong>the</strong> picture may jeopardise <strong>the</strong> function of MFR as a social<br />
