853.4 Notwithstanding paragraph 3.3, certain unregulated fishing may takeplace in a manner which is not in violation <strong>of</strong> applicable international law, andmay not require the application <strong>of</strong> measures envisaged under the <strong>International</strong>Plan <strong>of</strong> Action (<strong>IPOA</strong>).4. The <strong>IPOA</strong> is voluntary. It has been elaborated within the framework<strong>of</strong> the FAO Code <strong>of</strong> Conduct for Responsible Fisheries as envisaged by Article 2(d).5. The FAO Code <strong>of</strong> Conduct for Responsible Fisheries, in particularArticles 1.1, 1.2, 3.1, and 3.2 applies to the interpretation and application <strong>of</strong> this<strong>IPOA</strong> and its relationship with other international instruments. The <strong>IPOA</strong> is alsodirected as appropriate towards fishing entities as referred to in the Code <strong>of</strong>Conduct. The <strong>IPOA</strong> responds to fisheries specific issues and nothing in itprejudices the positions <strong>of</strong> States in other fora.6. In this document:(a)(b)(c)(d)(e)(f)(g)the reference to States includes regional economic integrationorganizations in matters within their competence;the term "regional" includes sub-regional, as appropriate;the term "regional fisheries management organization" means anintergovernmental fisheries organization or arrangement, asappropriate, that has the competence to establish fisheryconservation and management measures;the term “conservation and management measures” meansmeasures to conserve one or more species <strong>of</strong> living marineresources that are adopted and applied consistent with therelevant rules <strong>of</strong> international law;the term “1982 UN Convention” refers to the United NationsConvention on the Law <strong>of</strong> the Sea <strong>of</strong> 10 December 1982;the term “1993 FAO Compliance Agreement” refers to theAgreement to Promote Compliance with <strong>International</strong>Conservation and Management Measures by Fishing Vessels onthe High Seas, approved by the FAO Conference on 24November 1993.the term “1995 UN Fish Stocks Agreement” refers to theAgreement for the <strong>Implementation</strong> <strong>of</strong> the United NationsConvention on the Law <strong>of</strong> the Sea <strong>of</strong> 10 December 1982 relating
