In 2004, the government of <strong>Timor</strong>-<strong>Leste</strong> formally established the konsellu <strong>de</strong> sukuthrough Decree Law 5/2004. This legislation was specifically <strong>in</strong>ten<strong>de</strong>d as bridg<strong>in</strong>glegislation until consultations could be conducted and more comprehensive legislationwritten to govern this important area. It has s<strong>in</strong>ce been replaced by Decree Law3/2009. The fieldwork for this thesis was conducted <strong>in</strong> the last year of the first term ofoffice for konsellu <strong>de</strong> suku members, while they were still governed by Decree Law5/2004.There is one konsellu <strong>de</strong> suku for each of the 442 suku across <strong>Timor</strong>-<strong>Leste</strong>. Thekonsellu is hea<strong>de</strong>d by the xefe suku. Other konsellu <strong>de</strong> suku members <strong>in</strong>clu<strong>de</strong> all of thexefe al<strong>de</strong>ia, represent<strong>in</strong>g each of the al<strong>de</strong>ia with<strong>in</strong> the suku, one el<strong>de</strong>r, two women'srepresentatives and two youth representatives—one man, one woman. In Decree Law3/2009 there is now also one lia-na'<strong>in</strong> who is specially appo<strong>in</strong>ted by the konsellu <strong>de</strong>suku members dur<strong>in</strong>g their first meet<strong>in</strong>g follow<strong>in</strong>g election <strong>in</strong>to office. In the previouslegislation, the suku el<strong>de</strong>r had often operated as the council lia-na'<strong>in</strong>, and <strong>in</strong> fact <strong>in</strong>A<strong>in</strong>aro this <strong>in</strong>stitutional figure was referred to by everyone as the suku lia-na'<strong>in</strong>.In the preamble of Decree Law 5/2004, it was stated that the purpose was to"legitimise the role so far played by community lea<strong>de</strong>rs and bodies through elections".This gives an important clue on the legislative <strong>in</strong>tention <strong>in</strong> creat<strong>in</strong>g the konsellu <strong>de</strong>suku, where it represents a modified cont<strong>in</strong>uation of previous forms of localgovernance. Seen from this perspective, the <strong>in</strong>tention of the <strong>Timor</strong>ese governmentwas not to establish a new layer of governance, but rather to legitimise and to someextent co-opt exist<strong>in</strong>g local authority structures that had cont<strong>in</strong>ued <strong>in</strong> various formsthroughout Portuguese, Indonesian and UNTAET times. This un<strong>de</strong>rstand<strong>in</strong>g is alsomirrored <strong>in</strong> how the konsellu <strong>de</strong> suku is viewed <strong>in</strong> Venilale and A<strong>in</strong>aro, where timeand aga<strong>in</strong> it was confirmed <strong>in</strong> <strong>in</strong>terviews that the roles of xefe suku and xefe al<strong>de</strong>ia arenot viewed as 'new' roles, but as roles that had cont<strong>in</strong>ued throughout <strong>in</strong>terviewees'lifetimes but with different labels attached to them. However, there were also someimportant mo<strong>de</strong>rnis<strong>in</strong>g changes that were <strong>in</strong>troduced through the konsellu <strong>de</strong> suku,with the more conservative elements of local governance to be balanced through the<strong>in</strong>clusion of the women and youth representatives.119
