prefer the term 'local' to recognise the <strong>in</strong>herently localised nature of traditional justice<strong>in</strong> <strong>Timor</strong>-<strong>Leste</strong> (see for example Harr<strong>in</strong>gton, 2006, Grenfell, 2006). However, this hassimilar problems to '<strong>in</strong>formal' as there are also recognisably mo<strong>de</strong>rn local <strong>in</strong>stitutions.I argue that the difficulty <strong>in</strong> f<strong>in</strong>d<strong>in</strong>g the 'right' conceptual categories is because theissue goes well beyond term<strong>in</strong>ology. As Huyse and Salter po<strong>in</strong>t out, this discussion"puts a f<strong>in</strong>ger on a crucial aspect of traditional <strong>in</strong>struments to<strong>da</strong>y: they are hybrids andmove back and forth between their orig<strong>in</strong> and capture by the state" (2008: 8). It is notthe use of the word 'traditional' that is suspect, but rather the b<strong>in</strong>ary of tradition andmo<strong>de</strong>rnity and its <strong>in</strong>ability to embrace this hybridity. Customs that fall un<strong>de</strong>r theumbrella of 'traditional' need not come from a distant past, but may also be relativelyrecently <strong>in</strong>tegrated <strong>in</strong>to the <strong>in</strong>digenous political and social system (Hobsbawm andRanger, 1992). This is true of all societies as they have changed, a<strong>da</strong>pted, impacted onand been impacted by external forces. As Marcus and Fisher argue, "most localcultures worldwi<strong>de</strong> are products of a history of appropriations, resistances an<strong>da</strong>ccommo<strong>da</strong>tions" (1986: 78). The governance history of <strong>Timor</strong>-<strong>Leste</strong>, which hasgone through various stages of colonisation by the Portuguese, postcolonialcolonisation by the Indonesians, transition to <strong>in</strong><strong>de</strong>pen<strong>de</strong>nt statehood un<strong>de</strong>r theauspices of the UN Transitional Adm<strong>in</strong>istration for East <strong>Timor</strong> (UNTAET), and now<strong>in</strong><strong>de</strong>pen<strong>de</strong>nt <strong>Timor</strong>ese government is certa<strong>in</strong>ly a good example of this history ofappropriation, resistance and accommo<strong>da</strong>tion. Throughout this complicated history,and as discussed <strong>in</strong> chapter four of this thesis, <strong>in</strong>digenous <strong>Timor</strong>ese political systemshave a<strong>da</strong>pted to the overarch<strong>in</strong>g state structure. It is also clear, however, thattraditional i<strong>de</strong>as of socio-political legitimacy and political organisation that are<strong>in</strong><strong>de</strong>pen<strong>de</strong>nt of the broa<strong>de</strong>r state governance system have contemporary relevance and<strong>in</strong>form important aspects of people's <strong>da</strong>ily lives (Hohe, 2002a, McWilliam, 2005,Tr<strong>in</strong>i<strong>da</strong><strong>de</strong>, 2008).These historical forces have led to a political syncretism at the local level (Hicks,1983), commonly <strong>de</strong>scribed <strong>in</strong> contemporary analyses as political hybridity (Brownand Gusmão, 2009, Boege et al., 2009a). With<strong>in</strong> contemporary <strong>Timor</strong>esecommunities, while lisan cont<strong>in</strong>ues to be strong, there are also many <strong>in</strong>ternational,national and regional <strong>in</strong>fluences that reach down to the suku and al<strong>de</strong>ia levels ofgovernance. In this thesis, I argue that these <strong>in</strong>fluences are negotiated <strong>in</strong> structured6
