often because they reflect already exist<strong>in</strong>g power dynamics with<strong>in</strong> the suku. As such,it is only when we move away from these power dynamics that we can recognise the'th<strong>in</strong>ness' of the mo<strong>de</strong>rn <strong>in</strong>stitutional sphere, which is <strong>in</strong> turn a direct result of thepolitical economy of local governance <strong>in</strong> <strong>Timor</strong>ese suku. I argue that if we take acritical approach to <strong>in</strong>stitutionalism, we can take account of this empirical reality,mov<strong>in</strong>g beyond simplistic accounts of <strong>in</strong>stitutional 'weakness' or 'strength' torecognise the complex <strong>in</strong>teractions that arise as mo<strong>de</strong>rn state <strong>in</strong>stitutions are<strong>in</strong>corporated <strong>in</strong>to this local political environment.Second, functional approaches to <strong>in</strong>stitutionalism fail to recognise the reality ofpower, politics, agency and oppression with<strong>in</strong> local communities that produce the'shadow si<strong>de</strong>' of the every<strong>da</strong>y politics of mutual recognition, as exist<strong>in</strong>g <strong>in</strong>equalitiesrelat<strong>in</strong>g to gen<strong>de</strong>r and class are reproduced <strong>in</strong>to the mo<strong>de</strong>rn state <strong>in</strong>stitutions. Whilefunctional approaches to <strong>in</strong>stitutionalism tend to encourage simplistic analyses thatblame these <strong>in</strong>equalities on the ongo<strong>in</strong>g importance of traditional <strong>in</strong>stitutions, I arguefor a more nuanced policy response to address<strong>in</strong>g local problems that recognises themany positive elements that traditional <strong>in</strong>stitutions br<strong>in</strong>g to <strong>Timor</strong>ese communities,while also work<strong>in</strong>g to strengthen the mo<strong>de</strong>rn sphere of governance—essentiallybroa<strong>de</strong>n<strong>in</strong>g the overlap between lisan and mo<strong>de</strong>rn law. Such an approach wouldprovi<strong>de</strong> the basis for <strong>de</strong>velop<strong>in</strong>g a broa<strong>de</strong>r national politics of mutual recognition asenvisaged by Tully (1995) that would recognise the dist<strong>in</strong>ctiveness of <strong>Timor</strong>eseculture and traditions.Together with the <strong>in</strong>sights that this thesis offers <strong>in</strong>to theories of <strong>in</strong>stitutionalism asthey apply to hybrid political environments, I also seek to provi<strong>de</strong> new empirical <strong>da</strong>tafor un<strong>de</strong>rstand<strong>in</strong>g contemporary local governance <strong>in</strong> <strong>Timor</strong>-<strong>Leste</strong>. By unpack<strong>in</strong>g thecomplexities of local politics, I have isolated some of the po<strong>in</strong>ts of cohesion andtension that have emerged with<strong>in</strong> communities as they negotiate where they stand <strong>in</strong>the newly <strong>in</strong><strong>de</strong>pen<strong>de</strong>nt, <strong>de</strong>mocratic nation-state of <strong>Timor</strong>-<strong>Leste</strong>. In un<strong>de</strong>rtak<strong>in</strong>g thisempirical exercise, this thesis reaches three conclusions. First, as discussed <strong>in</strong> chapterfive, fieldwork strongly <strong>de</strong>monstrates that the coexistence of mo<strong>de</strong>rn and traditionalgovernance <strong>in</strong>stitutions should not be viewed as necessarily <strong>in</strong> opposition. While thereare some important po<strong>in</strong>ts of tension where the norms and values of mo<strong>de</strong>rn andtraditional <strong>in</strong>stitutions are <strong>in</strong> conflict, <strong>in</strong> many areas of communal life <strong>Timor</strong>ese195
