Financial AidFor a student who un<strong>of</strong>ficially withdrew (withdrew withoutnotifying the institution), this date is the date that theinstitution becomes aware that the student ceased attendance.The “date <strong>of</strong> institution’s determination that a studentwithdrew” is used for the following purposes:• It provides the dividing date between disbursed aid andlate disbursements; and• It starts the clock for the period <strong>of</strong> time withinwhich the institution must return federal funds.Drug Related ConvictionsA federal or state drug conviction can disqualify a studentfor federal student aid. Convictions only count if they werefor an <strong>of</strong>fense that occurred during a period <strong>of</strong> enrollment forwhich the student was receiving financial aid. A convictionthat was reversed, set aside, or removed from the student’srecord does not count, nor does one received when thestudent was a juvenile, unless he or she was tried as an adult.The information below illustrates the period <strong>of</strong> ineligibilityfor financial aid on whether the conviction was for sale orpossession and whether the student had previous <strong>of</strong>fenses.(A conviction for sale <strong>of</strong> drugs includes convictions forconspiring to sell drugs.)For a drug possession conviction, eligibility is suspended:One year from date <strong>of</strong> conviction for 1st <strong>of</strong>fenseTwo years from date <strong>of</strong> conviction for 2nd <strong>of</strong>fenseIndefinite period for 3+ <strong>of</strong>fensesFor a drug sale conviction, eligibility is suspended:Two years from date <strong>of</strong> conviction for 1st <strong>of</strong>fenseIndefinite period for 2nd <strong>of</strong>fenseStandards for a Qualified Drug Rehabilitation ProgramA qualified drug rehabilitation program must include at leasttwo unannounced drug tests and must satisfy at least one <strong>of</strong>the following requirements:• Be qualified to receive funds directly or indirectly from afederal, state, or local government program.• Be qualified to receive payment directly or indirectlyfrom a federally or state-licensed insurance company.• Be administered or recognized by a federal, state, or localgovernment agency or court.• Be administered or recognized by a federally or statelicensedhospital, health clinic, or medical doctor.Incarcerated <strong>Student</strong>sA student is considered to be incarcerated if he or sheis serving a criminal sentence in a federal, state, or localpenitentiary, prison, jail, reformatory, work farm, or similarcorrectional institution. A student is not considered to beincarcerated if he or she is in a half-way house or homedetention or is sentenced to serve only weekends.Incarcerated students are not eligible to receive federalstudent loans but are eligible for federal work study andfederal supplemental educational opportunity grants(FSEOG). They are also eligible for Pell grants if notincarcerated in a federal or state penal institution.If the student was convicted <strong>of</strong> both possessing and sellingillegal drugs, and the periods <strong>of</strong> ineligibility are different, thestudent will be ineligible for the longer period.Regaining Eligibility After a Drug ConvictionA student regains eligibility the day after the period <strong>of</strong>ineligibility ends or when he or she successfully completesa qualified drug rehabilitation program.
