the committee’s recommendations shall besubmitted with all building permit applications,and all pertinent building plans shall be stampedby the committee signifying that they are incompliance with all pertinent development planrequirements and conditions recommended bythe Design Review Committee. Consequently,any necessary revisions must be made to theplans prior to submitting them for a buildingpermit unless the applicant is not in agreementwith the committee’s recommendations.If a development application is recommendedfor denial, or approval with conditions that anapplicant is not in agreement with, the applicantmay appeal that decision to the <strong>Prince</strong> George’s<strong>County</strong> <strong>Planning</strong> Board through the specialpermit process.Special Permit ApplicationProcessSpecial permits are required for certaindesignated uses and for departures from thedevelopment plan. The requirements for specialpermits are shown in Section 27-239.02 of theZoning Ordinance. Any departure from the planis incorporated as an essential component of thespecial permit application and does not requirethe filing of a separate departure application.All requests for special permits shall be in theform of an application filed with the <strong>Planning</strong>Board. The required application form, andfees associated with the application, may beobtained from the <strong>Planning</strong> <strong>Department</strong>’sDevelopment Review Division or obtaineddirectly from the department’s web site.Prior to making a decision on a special permitapplication, the <strong>Planning</strong> Board shall hold apublic hearing on the application. The <strong>Planning</strong>Board hearing shall be scheduled not lessthan 45 days from the date the application isaccepted, unless waived by the applicant. Theapplicant is required to send (by certified mail)notice of the hearing at least 14 days beforethe scheduled hearing date to any municipalitywithin which the site is located and all ownersof abutting properties (including those directlyacross the street, alley or steam).In order for the <strong>Planning</strong> Board to granta special permit in the M-U-TC Zone foruses specified as such in the Use Table (seeAppendix B), it shall find that the site planis in conformance with the approved towncenter Development Plan and the guidelinestherein and any specific criteria set forth for theparticular use.To grant departures from the strict applicationof any standard or guidelines approved inthe Suitland M-U-TC development plan, the<strong>Planning</strong> Board must make the followingfindings listed in Section 27-548.00.01 of theZoning Ordinance:g A specific parcel of land has exceptionalnarrowness, shallowness, or shape,exceptional topographic condition, or otherextraordinary situation or conditions.g The strict application of the developmentplan will result in peculiar and unusualpractical difficulties to, or exceptional orundue hardship upon, the owner of theproperty.g The departure will not substantially impairthe intent, purpose, or integrity of theGeneral Plan, master plan, or the towncenter development plan.All special permit applications are referred tothe Design Review Committee for review andrecommendation.52 Approved Suitland Mixed-Use Town Center Zone Development Plan
