Division 5. Special Permits And Departures From The Development PlanSec. 27-548.00.01. Special Permits.(a) Authorization.(1) A Special Permit may be permitted by the Planning Board, in accordance with the provisions of Section 27-239.02.(2) The Planning Board is authorized to allow departures from the strict application of any standard or guideline approved in a Town CenterDevelopment Plan in accordance with the procedures set forth in Section 27-239.01 and subject to the following findings:(A) A specific parcel of land has exceptional narrowness, shallowness, or shape; exceptional topographic conditions; or otherextraordinary situations or conditions;(B) The strict application of the Development Plan will result in peculiar and unusual practical difficulties to, or exceptional or unduehardship upon, the owner of the property; and(C) The departure will not substantially impair the intent, purpose, or integrity of the General Plan, Master Plan, or the Town CenterDevelopment Plan.(CB-2-1994)70 Approved Suitland Mixed-Use Town Center Zone Development Plan
Subdivision 5. Special PermitsSec. 27-239.02. Special Permits.a) Procedures.(1) Application.(A) All requests for Special Permits shall be in the form of an application filed with the Planning Board. The Planning Boardshall determine the contents of the application and shall provide the application. The minimum submission requirements are:proposed; and(i)Six (6) copies of a site plan, and other graphic illustrations which are considered necessary to indicate what is being(ii) Six (6) copies of a written explanation by the applicant explaining how the proposed site plan satisfies the U-L-I ZoneDesign Guidelines or the Town Center Development Plan regulations and development guidelines.(B)(2) Hearing.The application may be filed prior to, or concurrently with, an application for a building or use and occupancy permit.(A) Prior to making a decision on a Special Permit application, the Planning Board shall hold a public hearing on the matter. ThePlanning Board shall adopt the procedures under which the hearing will be held.(B) The Planning Board hearing shall be scheduled not less than forty-five (45) days from the date the application is accepted,unless waived by the applicant.(3) Referral.(A) The Planning Board shall refer applications for Special Permits to the Department of Environmental Resources for itscomments or recommendations. These comments or recommendations (if any) shall be available for public examination at least seven (7) days priorto the public hearing.(4) Technical Staff Report.(A)The Technical Staff shall analyze the request and shall forward its comments and recommendations to the Planning Board.(5) Planning Board decision.(A) After the close of the record, the Planning Board shall take action on the request. The decision of the Planning Board shallbe based on the record, and shall be embodied in a resolution.(B)The Planning Board shall give written notice of its decision to all persons of record and to the District Council.(C) The Planning Board may only approve a Special Permit contrary to the recommendation of a municipality containing thesubject land within its boundaries upon the affirmative vote of four-fifths (4/5) of the members of the full Planning Board.Approved Suitland Mixed-Use Town Center Zone Development Plan1
