Policy Implications<br />
There are no relevant policy implications pertaining to this matter.<br />
Legislative Implications<br />
Under s6.28 <strong>of</strong> the Local Government Act, the Minister for Local Government is<br />
responsible for determining the method <strong>of</strong> valuation <strong>of</strong> land to be used by local government<br />
as the basis for a rate.<br />
In determining the method <strong>of</strong> valuation the minister is to have regard to the general<br />
principle that the basis for a rate on any land is to be:<br />
- Where the land is used predominantly for rural purpose, the UV <strong>of</strong> the land; and<br />
- Where the land is used predominantly for non-rural purposes, the GRV <strong>of</strong> the land<br />
Financial Implications<br />
Dependant upon rating methodologies utilised in the adoption <strong>of</strong> the 2009/2010 Budget the<br />
change in basis <strong>of</strong> rating for affected properties from UV to GRV will provide additional rate<br />
revenue opportunities to Council<br />
Conclusion<br />
In meeting its responsibilities to ensure equity within Council‟s rating systems Council has<br />
undertaken the necessary processes and consultation to make an informed decision in this<br />
matter <strong>of</strong> changing rating methods.<br />
The affected properties have been identified by Council to now be reflective <strong>of</strong> a non-rural<br />
purpose and therefore requiring to be rated utilising GRV.<br />
Voting Requirements<br />
Simple.<br />
RECOMMENDATION<br />
That Council resolve to request the Minister for Local Government to amend the<br />
method <strong>of</strong> rating from Unimproved Value to Gross Rental Value for rate<br />
assessments 5068, 5466, 71366, 72257, 72299, 76820, 76825, 76830, 77735, 77894 and<br />
78663.<br />
