A commercial valuation has since been undertaken and as a result <strong>of</strong> this the lease copies<br />

have been sent to Elkins Nominees Pty Ltd for signing.<br />

The new leases for DBY3 and Sanlea are currently in the process <strong>of</strong> being executed.<br />

Correspondence has been received dated 8 January 2009 from Richard Elkins, sole<br />

director <strong>of</strong> Elkins Nominees, advising that the contract has now changed hands once again<br />

and the business is currently being operated by Rob Mead and Kelly Wheeler <strong>of</strong> Wheeler<br />

Nominees Pty Ltd.<br />

Subsequent correspondence has been received dated 18 January 2009 from Wheeler<br />

Nominees requesting that a new lease now be drawn up between the <strong>Shire</strong> <strong>of</strong> <strong>Roebourne</strong><br />

and Wheeler Nominees for the lease <strong>of</strong> the Australian Air Express Freight Shed at Karratha<br />

Airport.<br />

Options<br />

Currently there is no formal lease in place for the lease <strong>of</strong> the AAE premises at Lot 6<br />

Karratha Airport. Given that Elkins Nominees have advised that they are no longer involved<br />

in the business and Wheeler Nominees have expressed an intention to enter into a lease<br />

with the <strong>Shire</strong> this would appear the best course <strong>of</strong> action to take. Elkins Nominees will<br />

continue to be liable for any rent costs incurred until such time as the new lease is in place<br />

with Wheeler Nominees.<br />

It should be noted that this new lease with Wheeler Nominees will not affect the previously<br />

negotiated leases for DBY3 Pty Ltd and Sanlea Pty Ltd.<br />

The new lease with Wheeler Nominees shall be at the previously valued rate <strong>of</strong> $20,100<br />

per annum for an initial term <strong>of</strong> 2 years commencing 1 January 2009, with the option <strong>of</strong> a 3<br />

year extension.<br />

There are no financial implications resulting from this report.<br />

Conclusion<br />

It would seem prudent for Council to approve this new lease between Wheeler Nominees<br />

and the <strong>Shire</strong> <strong>of</strong> <strong>Roebourne</strong> for the lease <strong>of</strong> the AAE Freight Shed at Lot 6 as there has<br />

been no formal lease in place for this building for some time.<br />
